A private laboratory hired by the prosecution in the Duke lacrosse case failed to report that it found DNA from multiple males in the accuser's body and underwear, according to a defense motion filed today. The lab, DNA Security of Burlington, found that the DNA did not match the three defendants, their lacrosse teammates or anyone else who submitted their DNA to police, including the accuser's boyfriend.
The new evidence emerged in thousands of documents handed over to the defense in October.

This is what we have been saying here for a long time. Now that lab and certainly that person is useless in court cases. They have been shown to violate policy and to color results to satisfy clients.
Defense or prosecution attorneys will pound them with this every time they ever go into court? I wonder if they are publically traded and I can run out and short their stock?
Again as we have said here over and over, Nifong is doing great damage to the judical system in NC and beyond. And it has now spilled over to private firms associated with this judicial system. Why the governor or AG can not see this and won't act is beyond me?

I was at a Christmas party and an acquaintance of mine is friend (I don't know how close) of Reade's parents.
She said they were confident of the outcome, but that the family is cash strapped right now due to the mounting legal bills, which she was told would boggle your mind!
this is second hand so take for what it's worth. But I can see it being true!
It is so sad, I hope these families can sue someone to get back all they have lost financially as well as their kids reputations!!!!
Your sure about that timing, Howlin? Not questioning you, it just makes Tweakfong a little less of a rectal swab if that's the case.
The ONLY thing that this lab reported was the DNA on the fake fingernail that "might" have matched one of the players..............AND.........now get this:
The DNA was contaminated AT THE LAB...........and guess whose DNA contimnated it?

Nifong needs to go to jail for this. Meehan, too, if necessary.
It is now quite clear that, in prosecuting this case, Nifong had only one objective: His Re-election.
What a disgusting human being.
Five years in the state pen would be a reasonable sentence -- if he survived it.
I'm willing to bet that the first lab got the same results.
Nifong, Gottlieb and Himan met with the DIRECTOR of DNA Security on 4/10 after the first round of tests, performed on anal and panty samples, were concluded and showed no match to lax players.
New tests were conducted by DNA Security on a pubic hair sample on 4/18 and 4/19. The results showed multiple partners, but no lax players or her boyfriend.
One to two days later, on 4/20 or 4/21, the director again met with Nifong, Gottlieb and Himan.
The director of DNA Security issued its final report to Nifong on 5/12, omitting the results showing the multiple partners, which violated the company's own policy that requires all results to be reported.
Sometime later DNA Security must have issued another report because the N&O article says this information was discovered in the discovery turned over to the defense in October.
We need to compare these dates to the various dates Mangum went in to look at photo arrays and to the dates that Nifong scheduled the proposed indictments to the grand jury and to the dates he presented the indictments and also the dates he requested the arrest warrants.
Clearly there's reason for a strong suspicion that Nifong asked the director to NOT include the exculpatory evidence in the May 12 final report (that evidently wasn't quite final, lol). The director is going to have to tell the truth about this or his company's credibility will be completely destroyed and he'll be out of business. The director had stated to DPD Investigator Soucie that he very much wanted his company to be involved in the case, so he may have been willing to play ball in order to get the notoriety/free advertising/prestige of being the lab of choice in the lax case.
If this can be proven through affidavits from the director of DNA Security and/or other personnel with the company, Nifong is in very serious trouble, and this is the first time I've ever thought he was in actual SERIOUS trouble, given the politics and laws of NC being favorable to his other known misbehaviors and ethics violations.
And I wonder if the director sent the report that included the exculpatory evidence when he saw the tide was turning in the case, or because the defense was asking questions of employees or writing letters to him, or just what prompted him to get out from under Nifong's request to quash those results, if in fact that's what happened.
Nifong cares not one jot about the guilt or innocence of the players. He can use them to feather his own nest and get even against the rich white boys.
Depending on how the lab handles this, they may be out of business soon.
I seriously doubt that guy is going to want to take this hit alone.
Thankfully the parents have the means to hire excellent attornies. The tragedy is thinking what could have happened if they were poor families.
My husband and I were just discussing this; if the DNA guy decides not to go down with the ship, Nifong just may go to actual prison.
He's probably ruined anyway; this is obviously a small company -- most likely some guy or guys how left LabCorp (which is in Burlington, too).........and if he doctored the reports, he's out of business.
