Baby Girl Was Born On Flight From Mexico To Chicago

(CBS) CHICAGO -- Immigration officials say it remains to be seen whether a baby girl born aboard a plane just before it landed in Chicago will be a U.S. or Mexican citizen.

Maria Elena Garcia-Upson is a spokeswoman for U.S. Citizenship and Immigration Services. She says a child born in airspace over U.S. territory is eligible for citizenship.

But the parents have to file an application, and then officials have to investigate whether the child was born in Mexican airspace or international waters, Garcia-Upson said.

A 42-year-old woman gave birth to the 7-pound, 8-ounce girl late Wednesday night on a Mexicana Airlines flight from Guadalajara, Mexico.

An obstetrician traveling on the plane helped with the birth about an hour before the plane touched down.

Would you happen to another interpretation for the second amendment to the Constitution, too? The 14th amendment is rather straightforward.

How long was the flight from Mexico?

I can't imagine this woman didn't KNOW she was in labor before she boarded the plane.

She came to this country with the sole intent of birthing an Anchor baby..and that should be FRAUD.

Not a new problem. My great-great grandmother gave birth to a son on a ship crossing the Atlantic from Europe. Uncle Will was referred to in the family as not having a country. Later this proved to be a little problematic as at the beginning of WW-II proof of US citizenship was required. Both Uncle Will and my father, who was born in a sod house in unorganized territory and thus did not have an official birth certificate, had to get sworn affidavits from older members of the family to prove their citizenship.

A war would need to include some sort of declaration thereof or deadly military action sanctioned under a general, admiral, or equivalent or higher military or paramilitary officer on one or more sides. Notwithstanding a few isolated incidents in the immediate border area, we continue to maintain an alliance, not a state of war, with the United Mexican States.

The millions of Mexicans streaming across our border do not pose a military threat to the United States; the criminal gangs among them do endanger the lives of our citizens, and we need to control our border and stop the flow of illegal immigrants. But eliminating birthright citizenship is not the proper way to control illegal immigration; it instead alienates Americans who are or were innocent children born in the wrong place. If illegal immigration continues without birthright citizenship, that creates a growing class of people in the United States without any inherent reason to respect our laws (beyond pure fear of our demonstrably incompetent law enforcement) because they cannot participate in the civic process. Such societies ultimately devolve into a ruling citizen oligarchy and a restive, repressed peasantry with neither American nor foreign citizenship and no country where they may reside legally.

Building and manning that border fence will give us actual control of our borders. If we can stop illegal immigration at our borders and open an efficient legal-immigration service, then we do not need to devise crude punishments for future illegal immigrants or their children. Why punish a child throughout his lifetime for the transgressions of his parents? Let us now build, guard, and maintain that fence.

Make that a formal state of war, with actual casualties (not people murdered by felon (murderous felon) illegal--American felons murder, too), and then it would apply.

I'll just leave the interpretation to those who are responsible for these amendments and the laws they enacted to carry out their amendments. You koolaid drinkers don't even have a solid supreme court ruling addressing either of these 2 amendments, yet want to replace the legislative history with your own ignorant bias.

No one has yet explained how national law and the citizenship clause were so radically changed in the 1960's without the constitution ever being amended.

And if it had been a British Airways flight and the woman a British national; no one on this forum would give a damn.

True, but we don't have a pandemic of Brits coming across our borders illegally. Most likely, the British mom would not seek citizenship for her child. You can't compare apples and oranges as it were.

Too bad this was meant to deal with the slaves brought to this country, against their will. It had nothing to do with immigration. And it was commonly known that it did not in the '30's. If it was intended in this way, it would have been applied this way from the beginning.
