Citizenship Uncertain For Baby Born On Plane

Baby Girl Was Born On Flight From Mexico To Chicago

(CBS) CHICAGO -- Immigration officials say it remains to be seen whether a baby girl born aboard a plane just before it landed in Chicago will be a U.S. or Mexican citizen.

Maria Elena Garcia-Upson is a spokeswoman for U.S. Citizenship and Immigration Services. She says a child born in airspace over U.S. territory is eligible for citizenship.

But the parents have to file an application, and then officials have to investigate whether the child was born in Mexican airspace or international waters, Garcia-Upson said.

A 42-year-old woman gave birth to the 7-pound, 8-ounce girl late Wednesday night on a Mexicana Airlines flight from Guadalajara, Mexico.

An obstetrician traveling on the plane helped with the birth about an hour before the plane touched down.

It would seem that since she's Mexican, and the plane is a Mexican carrier, subject to the jurisdiction of Mexico, the child is Mexican.

I'm sure someone will find a way around it.

Regardless of citizenship, she'll get to stay. Since when do we send back foreign nationals in this country?

So if you want your kid to be an American citizen, all you have to do is book a flight from Tijuana to Vancouver and induce labor right after takeoff. Or fly back and forth repeatedly until nature takes its course.

This makes no sense to me. I know kids born to diplomats while on US soil aren't automatic Americans. I'd think people just flying through our airspace would be treated the same.

The reason a woman that pregnant was flying to the US is patently obvious. The child should be denied citizenship. Furthermore we need to change the laws regarding the children of illegals. While I have no problem giving citizenship to the children of legal immigrants but the children of illegals should not be citizens. A shame we have to do this but rampant abuse of the law by Mexicans is forcing our hand. We need to stamp out the problem of anchor babies.

A Mexican plane is like a Mexican ship: It's a piece of Mexico and Mexican law applies to what goes on inside. The kid's a Mexican.

There aren't millions of dead beat brits in our country who are costing us billions in social services and ruining school districts nationwide.

Yup - no difference at all between massive migration from the third world and light immigration from our 1st-world "mother country". Pretty much the same impact on our society.

It is permissible to infer that this woman was legally traveling to the U.S. As for a commercial air carrier being the sovereign territory of its home country, that's simply false. A Mexican Air Force C-130, maybe.

Not according to international law it isn't. A plane flying over a country is in that country and subject to the laws of that country.

By the way, your ship analogy is also false. A Mexican ship in United States waters is in the United States and subject to all the laws thereof. In fact, a Mexican ship in international waters but en route to the United States may still, for such purposes, be considered to be subject to US sovereignty if the United States is the first country of entry following the birth.
