(CNN) Poll: Americans don't want politicians constraining judges

Despite politicians' complaints about judges having too much power, two-thirds of Americans do not believe elected officials should have more control over federal judges, according to a new CNN poll released Saturday.

Sixty-seven percent of 1,013 people surveyed by Opinion Research Corp. on behalf of CNN said federal judges -- and the decisions they make -- should not be subject to more control.

Only 30 percent said they should. (See the poll results)

Both a current and former Supreme Court justice told CNN they are not unaware of the criticism aimed at them, but they said such criticism is an integral part of life in a democracy.

"As I went through the last few years of service here at the court, I saw increasing indicator of unhappiness with judges," said retired Justice Sandra Day O'Connor.

But that unhappiness is a consequence of an independent judiciary, said Justice Stephen Breyer.

"It comes from the necessity that someone have the last word. And since for 200 years, people have thought in this country that the best guarantee that minorities will not be oppressed, that the Constitution will be lived up to, is to give the very last word to a group of judges who are independent," he said.

"Not because they are wiser -- they make mistakes -- but because, by giving them the last word, there is a better guarantee of that neutrality, insulated from politics, that can help those whom the Constitution wanted to help, that minority that might be oppressed."

I don't want politicians to have more control, I just want them to exercise the control that they are granted under our Constitution.

And just how does a Politician exert "Control" over a Federal Judge in the first place??

This is another meaningless piece of blue meat for CNN's viewers. The premise of the poll is meaningless, but that doesn't stop CNN from asking it anyway, and the DUmmies who watch from answering it.

Nothing to see here...move along...

My bet is out of the 67%, 66.99% of the people polled are Democrats and the poll was taken in a Blue state where oversamplimg of Democrats took place.

There is a huge difference between... "Politicians having more control over judges" which is unpopular... and

Judges following the constitution....

or

The PEOPLE having the ability to elect/recall judges.

What kind of story was this? It looks like a phony poll.

Another LOADED question.

Of course lected officials shouldn't have direct control of the decisions they make; they should have control over the selection of the judges and pass laws the judges should enforce!

If this poll is accurate, which I doubt, then the USA is truly and irredeemably FUBAR. Thus, I can't believe it.

CNN missed a big piece of analysis here. Unless you get 95% of the people to agree that the courts are functioning properly, they will lose the respect they need to work well.

Interesting that 30% already think the courts don't work.

They mean 67% of the rutabegas watching CNN think that - it'a a wonder that 67% of CNN watchers think at all.

You're probably right. I'd like CNN to show us the trend. No doubt more people want judge's to be constrained now than twenty years ago!
