It looks like a dumb move by Fitzgerald to me. He should have pulled this out in front of the jury on cross examination--not pretrial. Now the Libby defense will have ways to prepare for his attack against this expert witness. Pretty dumb if you ask me, and I am an attorney.

Loftus is an expert on the faulty memory of people being grilled by a prosecutor under oath and then she proved her own point by not remembering that she had previously been grilled by Fitzgerald under oath!
Sounds like a ginsu knive performance to me, especially when you remember that ginsu knives were cheap crappy ten dollar knives sold only on television.

If this expert witness was so clearly shown, by Fitz' withering attack, to have mis-remembered and forgotten all sorts of details...
Doesn't that make Libby's defense look all that much more reasonable? It merely shows that everybody can have moments where you forget about various details, or remember things wrong, or later recall something in clearer detail.
I don't see why that's a crime.
