In the Libby Case, a Grilling to be Remembered

With withering and methodical dispatch, White House nemesis and prosecutor Patrick J. Fitzgerald yesterday sliced up the first person called to the stand on behalf of the vice president's former chief of staff.

If I. Lewis "Scooter" Libby was not afraid of the special counsel before, the former Cheney aide, who will face Fitzgerald in a trial beginning Jan. 11, had ample reason to start quaking after yesterday's Ginsu-like legal performance.

It looks like a dumb move by Fitzgerald to me. He should have pulled this out in front of the jury on cross examination--not pretrial. Now the Libby defense will have ways to prepare for his attack against this expert witness. Pretty dumb if you ask me, and I am an attorney.

One of those moments came when Loftus insisted that she had never met Fitzgerald. He then reminded her that he had cross-examined her before, when she was an expert defense witness and he was a prosecutor in the U.S. attorney's office in New York.

What a goofy spin this reporterette puts on the story.

Loftus is an expert on the faulty memory of people being grilled by a prosecutor under oath and then she proved her own point by not remembering that she had previously been grilled by Fitzgerald under oath!

Sounds like a ginsu knive performance to me, especially when you remember that ginsu knives were cheap crappy ten dollar knives sold only on television.

I don't understand your statement at all. The article was putrid, but only in its obvious hope that Libby rots in prison over the Plame non-event.

Yeah, a few pardons to known friggin criminals and he had already been impeached by then. Libby isn't a criminal. He's the victim of a fraud perpetuated by the libs. Geesh!

I read the entire article. It was an asinine overselling of the effectiveness of Fitzgerald's cross examination. There's nothing under your Fitzmas tree, not even an old Scooter.

Excellent catch! The media wants Fitzgerald to be some super prosecutor, but all the facts so far show he is not. He really bungled this whole case.

Lets see! She did not remember having been cross examined by Fitzgerald in another case and that is what will prove to the judge that Libby should go to jail because he should have a perfect memory.

Fitzgerald proved that a memory expert has a poor memory of the contents of books she wrote... He must expect the judge to believe she got on the witness stand and committed perjury on purpose.

What better proof could you ask for than to prove that busy people can't remember things that happened and often think they remember what they said, whom they met, and wrote when they do not.

If Libby committed perjury then so did she. Fitzgerald just helped destroy his case against Libby.

No need. There's absolutely no chance whatsoever that Libby is going to get convicted of anything. Lionel Hutz could tear this ridiculous case to shreds.
