Tell the legislature in New Jersey how to vote on gay marriage by freeping this poll "Should gay couples in New Jersey have the same marriage rights as heterosexual couples?" - not that the legislators pay attention to what the people want anyway......

Should gay couples in New Jersey have the same marriage rights as heterosexual couples?

Gays already have the same rights as me. They cannot marry someone of the same sex and neither can I.

Don't all unmarried couples have the same rights. If gays get the same rights as married couples does that mean hetrosexual but unmarried couples will get the same rights as married couples. I think gay marriage is a really bad idea, and I have heard that a group is out there that wants a group marriage.

What bothers me is that most of the so-called "rights" the gays want are already available by other legal means.

...I have heard that a group is out there that wants a group marriage...this is a big question - if marriage isn't held to be strictly between a man and woman to provide the most beneficial setting for the raising of children, where do we draw the line? - gays, three people, groups, brothers and sisters, and on and on.....?

N.J. court opens door to gay marriage ...

making the state the second in the nation to allow gay marriage, ruling that lawmakers must offer homosexuals either marriage or something like it, such as civil unions.

the state Supreme Court declared 4-3 that homosexual couples are entitled to the same rights as heterosexual ones. The justices gave lawmakers 180 days to rewrite the laws.

The ruling is similar to the 1999 high-court ruling in Vermont that led the state to create civil unions, which confer all of the rights and benefits available to married couples under state law.

Cases similar to the one ruled on Wednesday, which was filed by seven gay New Jersey couples, are pending in California, Connecticut, Iowa and Maryland.

This is a poorly worded (maybe intentionally) poll question. It asks, "Should gay couples have the same rights to benefits as heterosexual couples?" Notice it does not say anything about "marriage." "Benefits" could be interpreted as healthcare, social security, inheritance, etc. While most Americans are against gay marriage, I think most would say gays should receive the same benefits. I think the question was designed to evoke a positive "yes" response.

Ya, I read that today also. The courts have ordered the state congress to pass legislation. Excuse me!?!?! What the HELL is that?!?! Can they do that?? It sounds to me like that particular court is seriously due for a hard bitch-slapping by the state congress. I sure hope they get it. Maybe someone can tell me just exactly what the court is going to do if the congress refuses. Fine them?

No, a court can't tell the state legislature what to do, nor can it enforce its decisions. For all practical intents and puroposes the only way judicial subversion can happen in an American style separation of powers system is with two branches working together.
