Reid's Land Deal (Philly Inquirer calls for Harry Reid to be replaced as Dem leader!)

A lucrative land deal benefiting U.S. Senate minority leader Harry Reid (D., Nev.) deserves full scrutiny by the Senate ethics committee.

In 1998, Reid purchased undeveloped residential property on the outskirts of Las Vegas for $400,000. He bought one lot outright, and a second lot with a partner, Jay Brown. In 2001, Reid sold the land for the same price to a corporation created by Brown. Reid retained an ownership stake in the corporation and continued to pay taxes on the property. There was no written agreement; Brown told the Associated Press that the two had been friends for 35 years and didn't need one.

So the Senate Democratic leader engaged in a seven-figure handshake and didn't feel the need to disclose all the details. Experts on Senate ethics rules say Reid should have disclosed the sale in 2001 on his annual ethics report, and informed Congress of his part-ownership in Brown's corporation. Reid didn't.

After the land was rezoned for a shopping center, the corporation sold it in 2004. Reid received $1.1 million in the sale, turning a neat profit of nearly $700,000 in six years.

While now insisting he did nothing wrong, Reid is also offering to make a "technical change" to his earlier ethics reports if the ethics committee so desires. Simply giving the Democratic leader a mulligan is hardly the way to handle this case. When the Senate debated ethics reforms earlier this year, Reid was out in front to demand the toughest of standards from lawmakers.

"Americans have been shocked and even disgusted by revelations of corruption in our current system by Republican lobbyists, senior Bush Administration officials, members of Congress, and former congressional staff," Reid said in March. "The scandals have shown that some outsiders and insiders believed they could act with impunity."

That's how this case looks, too. Unless Reid comes up with a better explanation for this lack of disclosure, Democrats should not keep him as their leader in the new Congress in 2007.

I completely disagree. If Hillary & friends were behind this they wouldn't have it coming to light 4 weeks prior to the most important mid-term election in US history. They would have waited until November 10, 2006

Maybe Hillary wants the Dems to lose this election so that she can replace Dingy Harry, not have to compete with a Speaker Pelosi AND be the savior of the Dems going into '08.

Did Rush say which son ? Rory Reid is county commissioner, and was sworn in on January 2003, which would be after the initial zoning ruling took place. Did he have a son on the zoning board when the zoning for the property was changed ?

But if Reid paid property taxes for an entity (donee) in which he had no legal interest and he didn't file Federal Gift Tax Returns documenting those payments, I think he's in trouble with the IRS...

He also has a gift tax problem if he sold the property to the LLC for less than fair market value and didn't file Federal Gift Tax Returns reflecting that gratuitous discount...

From the Instructions for IRS Form 709 (Gift Tax Return):

Generally, the federal gift tax applies to any transfer by gift of real or personal property, whether tangible or intangible, that you made directly or indirectly, in trust, or by any other means to a donee.

The gift tax applies not only to the gratuitous transfer of any kind of property, but also to sales or exchanges, not made in the ordinary course of business, where money or money's worth is exchanged but the value of the money (or property) or money's worth received is less than the value of what is sold or exchanged. The gift tax is in addition to any other tax, such as federal income tax, paid or due on the transfer...

The gift tax may also apply to the forgiveness of a debt, to interest-free or below market interest rate loans...

Thanks, Suzy. I recall Rush mentioning something similar as part of McCain's great strategery--sabotage his party in '06 to become its savior. Since Hillary has nothing to offer of her own, she may play the victim-turned-savior card. Think of the fawning from the talking heads.

Yesterday, the Inquirer ran the Reid story on Page 4.

Today they editorialize about it. Meanwhile, if you go to Philly.com (web site for both Philly papers), the story wasn't on the main pages either yesterday or today.

This story smells so bad that the Inky had to write an editorial (even though they gave him an out). But they'll keep burying the news well away from the front page so that fewer people see it. The old MSM two-step.
