When he donated the property to the partnership, he gave it a value of $400k. That way, he didn't owe any tax on the transfer. It probably was worth more than $400k at the time, since he had bought it 3 years earlier for that price. Whether he can do that or has to donate it at FMV is a question for a tax lawyer. My guess is that it is ok, so long as he pays tax on the difference between his $400k original investment and his sale price of $1.6 million.

You are right, the 1040s need a look. Only the Feds can do that.

The article doesn't say, but you are right, it would be easy to find out who the developer was. If there was corruption, it could be that the developer overpaid for the land or did Harry some favors in other deals. Something to check out.

Probably wishful enthusiasm on my part, but, I would sure LOVE to see one of these "tax the rich" liberals get nailed for tax evasion. That would make campaign commercial sound bites for decades.

According to Captain's Quarters who is all over this story:

The other part Reid wanted to keep secret was the financial ties between himself and Harvey Whittemore. The AP story reported that Reid bought the parcel from "a developer who was benefiting from a government land swap that Reid supported," a perfect description of Whittemore in 1998 when Reid purchased the land. For the next seven years, Reid would work to ease Whittemore's difficulties in developing the Coyote Springs project by forcing the government to swap its right-of-way for less valuable land owned by Whittemore; he tried to get the government to literally give away more of its land to Whittemore, although he would not succeed; and in the end, he pressed federal regulators to lift a endangered-species restriction on Whittemore's Coyote Springs real estate. All of this helped give Whittemore an opportunity to make tens of millions on residential and commercial development in the former test range site.

I didn't see that segment, but Megan Kendall did a story on it around 8:30 AZ time. I hope the story has legs, I don't see he is any different from Cunningham; if the ethics committee allows him to just ammend his reports I'm going to be really disppointed in the GOP.

The Whittemore angle provides a motive for keeping the partnership hidden. It may also explain how Reid got the property in the first place. The developer may have had the property identified already, figured out a way to have Reid get $700k and get the development done, using Reid's name and influence. The ostensible partner, Brown, may have been brought in just to get the zoning done, but the real partner all along may have been Whittemore.

Need to know the value of the land in 1998 and where Reid got the purchase money, among other things.
