It's easy to record a log of Instant Messages. AOL makes it easy. Someone once warned me back in the early 1990's that EVERYthing on the internet is traceable in one way or another. It was good advice back then and still is.

But to obtain logs legally don't you have to have a court order or be given them by the "owner". Who shopped these logs around to ABC and the newspapers? Where did they obtain them and how. There is a potential crime here that is being ignored. It is the right to privacy that the Dems have been screaming about all year. Foley is toast and rightly so but because he did something wrong does that excuse breaking the law to get him politically? This issue Where did these transcripts come from and how were they obtained is huge and needs to be investigated. Republicans did the right thing and denounced Foley. Now they need to do the right thing and investigate the source. It is not going after a whistle blower. If the shoe was on the other foot the Dems would be all over this like they were about the memos on the judges that were leaked last year. Then the issue wasn't that they were conspiring to illegally block judge nominations it was that Republican staffers had gone into the servers and pulled their PRIVATE correspondence out an released it to the public for political reasons. Staffers were fired for that as I recall.
