Prostitute nabs crooked cop with his own badge

BOSTON (Reuters) - A prostitute forced repeatedly into having sex with a Boston policeman said she feared the abuse would never stop -- until she stole his badge.

When the officer, Michael LoPriore, telephoned her to get it back, the FBI was tuning in to their conversation, the 19-year-old's lawyer, John Swomley, said on Wednesday.

LoPriore, 37, was charged in federal court on Tuesday with depriving the woman of her rights by using his position as a police officer to force her to perform sex in his car in September 2004.

Under a plea agreement, the 12-year veteran of Boston's police force will plead guilty, resign and never seek another job as a police officer in Massachusetts. Prosecutors are recommending that he serve a year in prison.

Swomley said LoPriore had stopped the teenager in a downtown red-light district known as the "Combat Zone" while he was off duty and in his personal car.

After showing her his badge, he ordered her into the car and drove to several locations where he forced her to perform oral sex, he added.

"She told me the badge was stuffed in a little cubby in the front console. His head was back and he wasn't really paying attention to where her hands were," he said.

You don't see a conflict here? First, do you consider prostitution a legitimate way to make a living? If he'd have given her 20 bucks instead of her suggested retail of 30 is it still rape? If a prostitute gets stiffed of her pay has she been raped? Get real.

A prostitute, like any other woman, can make a choice to have sex of not, depending on what ever values she happens to have. Are you saying that coercing a woman into sex is OK if she's a prostitute? How about if she works as a dancer, and no, I don't mean a stripper. Let's say you decide you want to dance with her at a bar... So you coerce her to dance with her, threatening her if she doesn't. Is that OK too?

We're not talking about a situation where she agreed to have sex, then he refused to pay. This is a situation where he said, "give me sex or you go to jail.

You really don't see something wrong with that?

BTW. Rape is an act of violence - specifically using force to get sexual gratification.
"Force" as in: 'there was no consent'.
It looks like you assume 'something precious' was taken means virginity?
How about human dignity - or are deflowered virgins just asking for it? I guess prostitutes and loose women - or say women who have had sex with more than (fill in the number of) men don't deserve protection or equal treatment from the more virtuous members of society.

Prostitution is a crime and committing crimes makes one susceptible to bad cops.

Actually this cop is guilty of Deprivation Of Civil Rights Under False Color of Authority. 18 USC 242.

It's a serious crime and can bring ten years in prison and a $250,000 fine. This cop is also open to Civil action under Title 42 Chapter 21 Subchapter 1, SS 1983.

Not that cops are ever prosecuted for this stuff, but the laws are on the books.

I've actually done quite a bit of research on that.

There are very few investigations and even fewer convictions.

It has to be something that is quite overt and outrageous and "shocks the conscience" of the community in order to get any attention.

The Justice Dept. does the investigations and files the charges.

Given the nature of this offense and the parties involved, that allegation would go nowhere.

It all depends on whether the specific sex act was consensual.

I believe the point of dungeonmaster's #28 and #41 is that, when she put it up for sale, she implied consent. Therefore, it's not rape. It's theft, aggravated robbery, something more along those lines.

It seems like a point worth considering.

It's kind of interesting watching folks twist about trying to diminish the actions of the, say it with me, Law Enforcement Officer.

I find the efforts, to say the least, ludicrous.

It's really very simple. If you force someone to have sex with you against her will, you have raped her. And here's how you can make the determination in this specific case. Replace the prostitute with a, for example, bank teller, or whatever 'honest' profession you choose. What would you call it then?

I think we all know the answer to that question, don't we?

Not really. Once a person says "no", it stops being "consentual" regardless of their occupation. Using the force implied by his position of authority, this cop crossed more than one legal line.

Because a prostitute does consent to sex for money sometimes, does not mean she has to consent to sex all the time, or with people, or under circumstances she doesn't want. In those cases it is rape.

If you did tax returns in exchange for money, would it be theft if a cop held a gun to your head and demanded you do his taxes, or would it be kidnapping, extortion, and false imprisonment?

Quit trying to justify rape in the case of prostitutes. If you do it, you won't be a thief, you will be a rapist.

But, try to see how that's not the same. The accused (okay, he's a cop, he's doubly bad) didn't steal the services a bank teller was selling.

He stole what a hooker was selling.

Yea, I can see where you might say this. There's a lot in common between stealing a hot dog from a street vendor and forcing a person to submit to your sexual demands with a threat of jail. I guess the notion of a crime against a person is no different that the theft of a hot dog.

In your view, clearly, a prostitute, cannot, by definiton, be raped.
