CA: ALL ELECTED GOP LEGISLATORS OPPOSE AB 32 - Will Hurt Economy, Increase Taxes

Assembly Bill 32, co-authored by Assembly Speaker Fabian Núñez and Assemblywoman Fran Pavley, will force California businesses to comply with costly and unattainable mandates to reduce carbon emissions. They will have to meet 1990 levels by the year 2020, threatening jobs and opportunity for thousands of hard-working Californians. Unaccountable state Air Resources Board bureaucrats will be given nearly unlimited powers to track and enforce the mandated emissions levels.

Not only will AB 32 drive businesses and jobs to Idaho, Utah, Montana, Arizona, New Mexico and other states that are actively encouraging job creation and economic growth, it also may push many companies to relocate in other countries that have no commitment to environmental protection. More importantly, AB 32 will do nothing to lessen the impact of emissions generated in China or other countries whose environmental damage has been far greater than anything that has occurred in California .

Keep in mind that while California is the world’s sixth largest economy, it only accounts for one percent of the total greenhouse gases produced. In contrast, China is the world’s 4th largest economy, yet it will produce approximately 20 percent of the world’s greenhouse gas emissions by the year 2020, and has publicly discussed plans to expand its coal-fired power generation capacity by 544 new coal-fired power plants.

In short, this measure will make little difference in the reduction of global greenhouse gas emissions. Its real impact will be the increased regulatory pressure on California ’s already heavily regulated businesses. The measure will also create the largest taxing bureaucracy established in our state since the Franchise Tax Board.

In effect, we will be giving unelected state bureaucrats the power to take “discreet” action – a term which is not defined in this legislation or anywhere else in state law – to remedy the impact of emissions in California . This could mean state gas tax increases of $1 per gallon or more for California motorists, or billions of dollars in higher taxes and fees for businesses and taxpayers – without legislative input or a vote of the people.

Any significant impact on global emissions will require a national consensus. A state-by-state approach simply won’t work, and in fact will harm our economy and may make matters even worse.

What are the regulations on businesses? Having a limit on how much travel/gas they can use, electricity in the offices, mileage for the service techs? What can they regulate or better question, what can't the regulate?

Calif is taxing itself out of business.My employeer just shut down a plant in California.Close to 300 people out of work.A new plant in Az was recently opened to take it's place.

The specific regulations have yet to be written but actions would include monitoring, reporting, and complying with arbitrary limits imposed by CARB. And you can be sure that the "environmental justice advisory committee" will not be too business friendly. Among other things, the new law requires:

• In adopting regulations, requires ARB to take into account environmental justice, equitable distribution of emission reductions, best available scientific and economic information, and other factors.

• Requires ARB to establish an environmental justice advisory committee and an economic and technology advisory committee for the purposes of advising ARB on implementation of the bill's provisions, and specifies appointment processes and procedures for those committees.

It also authorizes ARB to impose administrative, civil, and/or criminal penalties for violations of any "rule, regulation, order, or standard adopted by ARB pursuant to the bill's provisions." That's "Environmental Justice" in action!

Meanwhile, Nissan has just had it's first car roll off the line since they moved their national headquaters from SoCal to TN.

Thanks for the info. Sounds like the regulations are vague enough to include anything and everything, thus completely hand tying a business until it is OUT of business. Is this what the socialists in CA government want? No private business just government jobs that they can run corruptly like Mexico? What a pity. Coming to a state near YOU folks.

Boiling it all down, the bill essentially authorizes CARB to become GOSPLAN West. For any business to operate, it must emit CO2, either directly or indirectly. Thus, complete regulation of CO2 emissions necessarily and essentially becomes complete, intrusive regulation of all aspects of business activities. If this monstrosity passes, California can kiss good by to any pretension of having even a minimally free economy.
