PERTH, Scotland A Scottish woman may appeal after losing a suit against Britains National Health Service for compensation after the NHS failed to kill both her twin daughters in the womb.
Stacey Dow, the mother of now five year-old surviving twin Jayde, demanded $250,000 from the public health service for support for Jayde, the daughter she never intended to raise. The case was a first of this kind for Britain, commonly called wrongful life or wrongful birth suits. She said after being informed of the courts decision that she would be consulting with her lawyers for the next step.
In 2001, Dow, then sixteen, attempted to abort both her children at seven weeks from term at Perth Royal Infirmary, a hospital of the Tayside University Hospitals NHS Trust. When Jayde survived, Dow claimed the money for compensation to raise the child.
She told the Scotsman this week, Jayde started school two weeks ago and is enjoying it. I still want to do the best for her, but it's exhausting dealing with the legal side.
Perth Sheriff Court, Sheriff Michael Fletcher said that the NHS is not liable for the support of a child they failed to kill through abortion. He said that because a doctor uses the word termination does not guarantee success.
He could not be held to have done so impliedly, or because he had used the word termination, the sheriff said.
Dow told reporters on a previous occasion that she had not yet decided what to tell her daughter about the case. Maybe when she is nine or ten I will sit her down and explain it to her, she said.
I pray this woman, by some miracle, realizes the path she's headed down (and I do mean DOWN)....
And these are the people who call me and other Soldiers "Baby Killers"??!!??
If someone gives you a gift, and you refuse the gift, or throw it away disdainfully, then that gift-giver will be either very angry, or very saddened, or both. God gives us our children as gifts, regardless of how they were conceived......
I guess the suit is called "wrongful life," instead of "wrongful death."
A blind man could have seen this coming.
ping
She tried to kill the child, did kill one and they ler her keep the child????
I am so lost.
So, if she didn't want this child, why didn't she give her up for adoption. I'm sure someone would have wanted her.
Now she's just using the kid for free money.
I wonder where the father of this poor child is.
I weep for both children.
I thank you for your service. I will keep you in my thoughts and prayers.
Not as lost as that woman is.
Clearly this man is no father or we would know where the father was.
The "mother" and the former twin.
Her offspring Jayde now lives with her grandparents. Stories have reported that Stacey Dow lives with the grandparents and the child, but other accounts put the grandparents and child together with Stacey Dow living apart from them.
Western civilization has sunk lower than I thought if this woman doesn't realize how despicable she is.
Incredible but yes, it is a "wrongful life" suit. Wanting damages because the state failed to properly kill your child.
This woman is sick sick sick. Problem is, the young girl will suffer from it the most. The logical conclusions of abortion are being demomnstrated in real-life tradgey. I feel anger mixed with tremendous sadness.
If you really wanted to do what was BEST for her, you would have sat tight for another measly seven weeks, given birth, and let BOTH sisters be adopted out to people who wouldn't whine in public about how they should never have been born.
I don't know how the poor kid sleeps at night.
