Charges possible in death of Anna Nicole Smith's son; coroner awaits report

JESSICA ROBERTSON NASSAU, Bahamas (AP) - Authorities believe they know what killed the 20-year-old son of Anna Nicole Smith but are awaiting a toxicology report to confirm their findings and are holding open the possibility criminal charges, the Bahamas coroner said Wednesday. Coroner Linda Virgill told The Associated Press that once her office receives the toxicology report on Daniel Smith it may launch a formal inquiry and that there is a possibility criminal charges may be filed in Sunday's death.

"We do know the cause of death," Virgill said. "But we need to confirm it with a toxicology report."

...

Deepening the mystery, Virgill said there was at least one other person in the room when Smith died. She refused to elaborate.

"I can confirm that there was definitely a third person in the room at the time of death and I do know who that person is," she said. "But I am unwilling to reveal that information at this time for various reasons."

Two small items:

.The attorney speaking on Anna Nicole's behalf on TV this afternoon is named Michael Scott - not sure on which matters Howard K. Stern and this attorney represent her - she has many more lawyers, but this one seems to be doing today what Stern had been doing in previous days, i.e., speaking on her behalf

.A tabloid TV show reported this afternoon that ANS was heard screaming "It's all your fault" in her hospital room at the time Daniel was found. (Consider the source - I"m just the messenger.)

She went to the Bahamas because the father of the baby wanted custody.

I'm thinking that, too - if it's something in the tox screen that caused his death and it wasn't anything destructive that he himself knowingly ingested on purpose, then it could have been something that was put in his food or drink *without* his knowledge.

The Bahamian authorities just said on our local news they won't be releasing the autopsy to the public when it's ready on Friday. That's the same thing the attorney Michael Scott said earlier on the tab TV show. We shall see.

Birkhead's attorney (didn't catch his name) also made the statement this afternoon that he will be going after custody of the baby *now.*

1993 through 1995, I worked at Houston's nicest restaurants. J. Howard Marshall loved Tony's and Anthony's, and we saw him in there frequently, especially in 1993.

At the time he was 87 or 88, and frankly I couldn't believe he was still moving. He was oooooooold.

His death, unlike his marriage to Anna Nicole, was no surprise.

(And yes, he has some amazing Houston stories. Someday I'll tell y'all about Lady Walker, his stripper girlfriend before Anna Nicole.)

Wow. I'm starting to think edcoil was right on the other thread, and the balloon burst.

Ed, you still takin' heat for that theory?

My personal theory, FWIW: Anna has been drug free for the past 9 mths. She, Howard and her son may well have been having their own "private party" in her room - in celebration of Anna's return to the drug scene. Everyone fell asleep, but the son died of an overdose.

Reasonable, except... why would someone go to all the trouble to stay clean for 9 mos. (presumably for the safety of another human being) and then throw it all out the window at first opportunity? Oh wait, we're talking Anna Nicole here. Even if she did manage to exhibit responsible behavior for a few months, she is a very stupid woman and incredibly self destructive.

Maybe she wasn't drug free at all, but decided to have a little party to celebrate the birth. Everyone in that room, dead or alive, needs a toxicology report. :-/

I think it's the one where you said the "balloon burst".

There were those who didn't understand what you were referring to. I did..

We'll see..

Howard K. Stern is her attorney/keeper. He appeared with her all the time on her reality show and has been with here for years and years and years. I suspect that he is her "emotional anchor" for what it's worth.

Supposedly (from what I'm hearing anyway), he was the third person in the room which would explain why she needed another attorney.

Again, rumors say the father is a photographer who was saying months ago that he an Anna were having a child although they are now estranged.

I wonder if drugs were involved. The yelling, "It's all your fault" puts an interesting spin on this. I feel sorry for her. She seems emotionally fragile to begin with ... then the hormones and intensity of labor ... then the death of her son who she always appeared to love. And he, her.

Howard and the son may have been partying. She may have been clean.

so you think he may have been transporting drugs from the US to the bahamas? how long had he been in the bahamas before going to the hospital, did he go directly from the airport?

It sounds like it, I would like to be proved wrong and sorry this entire situation is where we are at and the loss of her son.

This entire thing --- sucks.

Wouldn't anyone who knew him well have been able to pick somewhere a little less crowded, and a little less likely to manage to save him, than a hospital?
