The story says "an army investigator." One investigator is not representative what the Army command will decide. Can anyone say - Paul Hackett! What a nut he is and he is a lawyer that was in the Army!

If you're talking about the Paul Hackett who ran for office in Ohio (and failed), he was a marine, not Army.

We have plenty of our own douchebags without taking responsibility for those of other services.

I am always a little leary of officers not in Infantry who sit in judgement on soldiers who are in Infantry.

The good news is the Jury will probably consist of infantry types who have served in Iraq.

I'm with you on this! What the hell is an army investigator doing recommending the death penalty in an ongoing case? Investigators gather facts and present them to the Court-Martial Convening Authority, in this case a General Officer, I'm sure. Next there should be an Artcle 34 Hearing to determine if the charges are valid and if so, the accused soldiers should be bound over for trial. If found guilty of the charges, the military judge will make determination in the penalty phase of the trial and based on the Articles of the UCMJ, whether the guilty soldiers' infractions warrant the death penalty. Any military lawyers out there? This is crazy!
