The cheerleader and the shooter.
He does look like he wandered out of a horror movie.
These kids were stupid. The guy's patently nuts, which is why the house has a reputation. For these girls to go to the house of a nutcase was foolish.
That said, this guy did a very wrong thing, and will pay for it.
Here's a tip for high school kids: Stay off other people's property, especially if that property has a reputation for being dangerous.
I live just outside of Worthington and saw this on the news. The guy is kinda weird (aside from the fact that he attempts to cut his own hair Franciscan style). Apparently his claim is self defense against "juvenile delinquency"=running up onto his portch. Man, I wonder how many Bible sailsmen or J. Witnesses he's bagged already...urban hunting at its finest...pardon the shrewed sacrasm.
In Texas, this would probably have been ruled justified already. They trespassed after dark, left, then came back with unknown intentions.
I would have opened fire, too.
The cheerleader looks old-er than, say, high school age.
All high school girls do these days.
I'd like to think you'd identify your target first and assess the threat.
Unfortunately some anti-self defense lawyer will use this case to try to screw with the rest of the law abiding population.
The guy fired out his window at a moving car. His chances of claiming legitimate self defense are zero.
"I regret that (Barezinsky was shot)," he said.
A head shot and a chest shot?.....he took careful aim. He did exactly what he intended to do.
Texas Penal Code Section 9.42:
DEADLY FORCE TO PROTECT PROPERTY. A person is
justified in using deadly force against another to protect land or
tangible, movable property:
(1) if he would be justified in using force against the
other under Section 9.41; and
(2) when and to the degree he reasonably believes the
deadly force is immediately necessary:
(A) to prevent the other's imminent commission of
arson, burglary, robbery, aggravated robbery, theft during the
nighttime, or criminal mischief during the nighttime; or
(B) to prevent the other who is fleeing
immediately after committing burglary, robbery, aggravated
robbery, or theft during the nighttime from escaping with the
property; and
(3) he reasonably believes that:
(A) the land or property cannot be protected or
recovered by any other means; or
(B) the use of force other than deadly force to
protect or recover the land or property would expose the actor or
another to a substantial risk of death or serious bodily injury.
There *are* some seriously violent girl gangs running around now. I sincerely doubt that these girls were wearing cheerleading uniforms; in fact, it's getting hard to tell normal girls apart from the gangbanger chicas these days, what with "fashion" being what it is.
The other thing is that in Texas, everyone knows that trespassing is a horribly stupid idea, so only people with malicious intent would do what these girls are described as doing.
"Hrnjak"
"I'd like to buy a vowel please."
Ours doesn't.
Unknown people trespass on your property. One of them, in a car, blows their horn (possibly to alert the trespassers that the police are coming), and everyone runs away. A few minutes later, the same car comes back and idles at the curb.
Gee, what do you think these people might have in mind at 10pm, hm?
I *really* doubt that the car "wasn't moving".
A stadium full of people ?? ....this girl may be loved, but she was being a common delinquent trespassing...the guy was nuts, but she was wrong as well. I will pray for her complete recovery, but she did put herself in danger and is suffering the consequences. She is not an innocent bystander in this. She meant to harass that family. Somehow, the public display is a bit much. Perhaps those people should have gone to church privately and prayed. This is just weird.
Natural selection at work.
But she wasn't on his property when he shot the girl. She was in the car driving past when he opened fire.
Which, IMHO, makes it highly unlikely that the car was moving.
