Mexican woman accused of smuggling 13,000 rounds [into Mexico]

McALLEN, Texas -- A 42-year-old Mexican woman is accused of trying to smuggle 13,000 rounds of ammunition into Mexico, federal prosecutors said Wednesday.

Balbina Morales-Oscoy, of Posa Rica, Veracruz, was arrested at the Pharr international bridge Aug. 4 after U.S. Customs and Border Protection officers said they found 19 boxes of .22-caliber ammunition and about 2,500 rounds of .38 Super ammunition concealed in soft drink boxes in the vehicle she was driving.

She was charged with conspiracy to export defense articles, a felony.

A federal Immigration and Customs Enforcement investigation began Aug. 2, after ICE agents received information from the Bureau of Alcohol, Tobacco, Firearms and Explosives regarding a vehicle with Mexican plates suspected of being used to export ammunition.

ICE agents said they watched Morales-Oscoy as she drove to various locations and bought ammunition and groceries, then stopped at a residence and unloaded and reloaded groceries into a minivan.

CBP officers at the international bridge found the ammunition and detained her. She has been in federal custody pending a detention hearing Thursday.

If convicted, she faces up to five years in prison and a maximum $250,000 fine.

This is another consequence of the rabid expansion of the "Interstate Commerce" clause. To my mind, this is the greatest current threat to liberty. The ATF knows that if they regulate based on the second amendment it is a non-starter. Their regulations are based on the Interstate Commerce clause.

Per the US Constitution, the legislature can regulate Interstate commerce, but because, per the supreme court, any transaction can become interstate at any time, the federal government has granted itself the ability to regulate ALL commerce, at any time, or even potential commerce. What you do in your garage, as a hobby, or even think in your head can be regulated because at any time you may decide to turn a thought into commerce.

Students of Constitutional history know that although imports can be regulated and taxed (tariff) the federal government was not given the authority to tax/regulate exports.

There are thousands of bureaucrats whose function is to regulate free speech (to include books on mathematics which may be used in cryptography) and other exports. They simply classify the book as a weapon, and it becomes subject to regulation.

I worked for a truck company. We were in negotiations to sell a truck with a crane on it to a foreign nation (an ally). We asked what was the biggest load they wanted to lift with the crane.

The faxed reply, "A pallet of 155 artillery ammunition" turned our truck into a "weapon" and we had to stop work for 6 months while the government responded to our paperwork.

Needless to say, we lost the contract. We couldn't even tell our customer why we were not responding to him for 6 months.

No FOID in WA or OR, both Right To Carry states.

I know for sure the JBTs require them in MA and IL - Not sure about the peoples' democracies of Kalifornia, NJ, RI, and NY. Anyone know about the second smallest state? Ct is a right to carry state, but I think you have to have one of these cards there too.

Crazies? I'll bet your city has more murders annually than the whole state of Idaho. We're armed and polite in Idaho. Gun control results in crime infested pestholes.

No FOID Card.

In Texas, we do not have any such regulation. Ammo is not registered or logged, ID not required. Same with reloading components.
