Midshipman Acquitted of Rape Charge

WASHINGTON -- A military jury on Thursday acquitted a former Naval Academy quarterback of raping a female midshipman in her dormitory room.

But jurors convicted Lamar S. Owens Jr. on charges of conduct unbecoming an officer and disobeying a lawful order.

"They have determined, obviously, that the consensual act took place," said Cmdr. John Maksym, the trial judge. He added that the jury of five Naval officers found that Owens "wrongfully entered the room without permission and wrongfully engaged in consensual sex."

Owens, standing at attention as the verdicts were read, showed no emotion. He remains free without bond. He was not allowed to graduate or receive a commission in May, and remains a midshipman.

Neither Owens' accuser nor her family were in court when the verdict was read.

The punishment phase will begin Friday morning.

"wrongfully engaged in consensual sex" definitely indicates somebody else has a problem.

Oh, man. The incident took place in Bancroft Hall. Even I've heard of that, and I've never been near the place, nor have I ever been in the Navy, or in the military.

Shame to have such a famous and storied place associated with this.

Does that mean the girl was also kept from her graduation, commission, and has charges filed against her?

There's been a ton of stories about thios in the local press. The victim was not very credible at all. The trial judge took the prosecutor to the woodshed a number of times.

The big thing about this trial was that the Femi-nazis were out for blood. There was a committee that had just ripped the other academies a new one and showed up in Annapolis the same time this emerged.

Owens screwed up, but the PC Police were out to get a scalp, any scalp to "send a message".

She was promised that all would be forgiven if she gave truthful testimony. I believe the trial judge had to remind her attorney of that fact during the proceedings.

The punishment phase will begin Friday morning. Prosecutors recommended a sentence of two years on the conduct unbecoming an officer charge. The judge tabled discussion of a sentence on the failure to obey a lawful order charge until Friday.

I believe that sex in Bancroft gets you tossed from the Academy.

That "failure to obey a lawful order" charge is probably where he was told to stay off her floor after this broke and he was seen walking the hall.

So far, no word on who she is. Down the road, though, her career in the military is garbage.

No doubt the Board stood on their heads when they came up with that one. Last time I saw something like that the USPS Board of Governors misused the word "tangential" and came up with something like "tannedgenital". And, lo and behold, that's what we have here don't we.

I was told, and took very seriously the advice to just stay the hell away from FM's... If you can't do that, at least keep your diddeling miles from the flagpole.

It seems that he didn't do anything criminal, but IMO, he should have know better.

Only sad part here is that she was given total immunity from prosecution for all the Academy rules she broke, in exchange for her truthful testimony. He gives truthful testimony and gets time, possibly. So, for breaking the same rule (sex in the hall) she gets a walk. Makes sense to me. /sarcasm off

IMHO, the "wrongfully entering the room" part has to do with rules regarding male middies being in female middies' rooms (and vice versa) - they are very picky about when and how you can go in. The "wrongfully engaging in consensual sex" refers to violation of the regulation that prohibits having sex in Bancroft Hall. Although the wording is convoluted, I believe it was very carefully crafted to keep anyone from coming back on the trial board for discrimination.
