Announced by Arlen Specter, reported by CNN and Fox. Hasnt hit the wires yet but I should have a link soon. Specter called the negotiations with the White House torturous.
After giving Geneva rights to the terrorists, the administration are really taking it in the pants this week. My initial reaction is a bit of shock and some disappointment.

The name "Arlen Specter" leaves a bad taste in the mouth just by saying it.
Is there NO end to this Wuss's caving in on EVERY issue?
I like and respect W, except it appears he has no backbone or will to take on ANY opposition regardless of the circumstances.
I can appreciate his wanting to act Presidential and remain above the fray, but common, there is a limit.
Trying to operate on the oppositions creed of "why can't we just get along," simply does not work--never has, NEVER WILL!!
The FISA court has ruled the President has the Constitutional Authority on some individual cases but not the program as a whole so if FISA rules against the administration then it will be hard for them to reconcile their position with the previous rulings. If FISA does rule it unconstitutional then it could be appealed to the SC where even the FISA court could be ruled unconstitutional because it takes a constitutional amendment to strip Constitutional Presidential Authorities.
Is there any way to put a bounty on the ACLU? What more can they do to our country.

they don't need to be engaging in negotiation on this, or submitting it to the court.
act as a co-equal branch, exert this power - and if the other two branches want to do anything to thwart that, let them act on their own to do whatever they want. if congress wants to impeach the president over this, let them make that move. if the courts want to stop it, let them make that move.
and all the while, the president needs to be making the case to the american people about what actions are needed in the war on terror - so when/if the other branches act to undermine that, the people can see it and vote on whether they agree with it or not.
One of the things not mentioned is the probability that after it's submitted the FISA court may even rule that they don't want to be involved in a battle between the executive and legislative branch.

judge andrew napolitano talking about this today - he says FISA will rule against the administration in this case. he predicted the Hamdan outcome from the start, so I trust his judgement.
