Delay has resigned and moved to Virginia. He has no intention to serve. You might as well have a dead man on the ballot. No way the Fifth Circuit is going to permit that.

If DeLay were dead, the Republicans could replace him. My understanding is that DeLay is not in favor of that option.

The Democrats kept Patsy Mink on the ballot. Mink died one week after winning the primary in Hawaii. She won posthumously.

BTW, the Democrats were arguing for Mink to remain on the ballot simultaneously with arguing that Robert Torricelli should be removed from the ballot in New Jersey.

Tom Delay is a virtual dead man. Mel Carnahan was an actual dead man and won a Senate seat in Missouri. Other than that I agree with your assessment.

Are you just focused on a results-based outcome in this case, or do you have any concern for what the law actually provides?

Then why did he leave his name in the primary ballots? Oh, that's right, so he could raise campaing money to use for his defense fund. Delay can withdraw if he wants, but he was trying to game the system by staying on through the primaries, and hoping the party chairman could replace him, even though Texas law states that this cannot happen.
