Can dismissal of the Delay case be far behind?

A ruling on Friday against Ronnie Earle suggests that the Delay case dismissal should soon follow:
AUSTIN A state district judge threw out a felony indictment against the Texas Association of Business on Thursday, ruling that the groups ads in the 2002 legislative elections did not expressly advocate the defeat or election of candidates.
The ruling is probably a significant blow to Travis County District Attorney Ronnie Earles prosecution of the states largest and most powerful business lobby.

Judge Lynchs order said prosecutors theory of illegal campaign expenses, while innovative, cannot be found in the state election code. Even if it were, it would be unconstitutionally broad and vague, he said. I guess we have a new definition of innovative.

Even if it were, it would be unconstitutionally broad and vague, he said. Innovative would be putting a good spin on Earle's charges. He basically fabricated new laws against an accepted practice on both sides, selectively enforced them, and even had to jury shop to get an indictment from a jury who's foreman is on tape saying he knew Delay was guilty just from seeing the political ads(long before the case was even presented).
I can't wait until Delay brings charges against Earle.

True, if the main felony charges are thrown out, if Delay can't get off the ballot, could he change his mind this week to run again?

I doubt DeLay will be prosecuted. The Democrats got rid of him and he's no longer in Texas. So there's no reason for Ronnie Earle to press ahead with the case.
(The Palestinian terrorist regime is the crisis and Israel's fist is the answer.)

It's my understanding that the Dems are saying that he hasn't really moved. That way someone else can't be put on the ballot in his place. What a riot if this backfired on them. Although, I'm sure they will now say that he has, indeed, moved.

The very first thing on the agenda of the next Texas legislative session should be to strip the Travis Co. DA of the authority to bring charges against legislators who live outside Travis Co. There is no reason to have Ronnie Earle or his liberal successors(and this being Ausin, the blue anus of Texas, they will always be liberal) the power to indict Republicans from all over the state. This should have been done immediately after Texas Republicans won the majority, but as usual, they were asleep at the wheel.
