NEW ORLEANS, June 27 (Reuters) - Poor blacks in New Orleans sued on Tuesday to stop the government from replacing public housing units with mixed-income dwellings, calling it a discriminatory move that would bar them from coming home after Hurricane Katrina.
The federal Department of Housing and Urban Development (HUD) plans to raze more than half of the low-income housing units it oversees in the city and replace them over the next few years with units the agency says will be better and safer.
"HUD plans to keep low-income black families out of New Orleans," said Judith Browne, co-director of the Advancement Project, a national civil rights organization that filed the suit along with black families.
The agency rejects the notion that it is excluding anyone, although it has said there will be fewer low-income units.
"We'd like it to be a better future and not the deplorable conditions they were in before," said HUD spokesman Jerry Brown. "Everyone who was residing here before has the right to return."
He declined to comment on the details of the lawsuit because he had not seen it.
The majority of New Orleans residents were black before the Aug. 29 storm, and public housing residents were overwhelmingly black, but a higher percentage of generally better-off whites have returned.

The plantation doesn't like change but always needs more taxpayer funds.
Why don't they buy one of those high rise buildings that is on the safe side of the river and empty due to no workers and turn them into condos?
If they aren't paying for their housing then they have no "right" to return anyway.
Get a job and buy your own place.
What happened to the $2 billion dollars they can't account for?
The gov. redid her house, and the mayor bought buses that run???
Maybe thats some of the monies that William Jeffereson D-LA had in his freezer??? Any other freezers near or in his house, did you look inside????
And people are crying cause nobody helped them....maybe they should ask THEIR leaders in LA. 'where's the money'???
Was Wolf Blitzer there to comment that they are "So poor, and so black."
Translation: Some people deem it their right to be kept as pets by the society they are in.
Whatever it takes in funds to do it, "federal" or "state", is courtesy of the working citizens and taxpayers. They are the 21st century slaves.
Which is all right, because that's not "racist".
These are the same people who have been protesting for weeks in front of various housing projects demanding that they be allowed to return to "their" apartments. They've turned to the courts because their antics have alienated virtually everyone in New Orleans, including middle-class blacks and the local TV/radio stations. My favorite part of this has been watching people in their forties proudly proclaiming that they've lived their entire lives in the projects and honestly believing that revealing this will make me sympathetic to their cause.
Why would anyone want to live in those conditions when a little effort would avoid it? Sadly, it may be the slave mentality, without the requirement of labor.
Time to shut that place down, cut checks and let people disburse. Its lose lose for everybody.
Get a job and buy your own house.
You're free. Get over it.
I know by direct observation that the housing projects in New Orleans were absolute hell. That these folks are suing to return to that shows how little self-respect they have.
In other news, the sun rose in the east this morning.
