(AP) -- Rush Limbaugh could see a deal with prosecutors in a long-running prescription fraud case collapse after authorities found a bottle of Viagra in his bag at Palm Beach International Airport. The prescription was not in his name. Limbaugh was detained for more than three hours Monday at the airport after returning from a vacation in the Dominican Republic. Customs officials found the Viagra in his luggage but his name was not on the prescription, said Paul Miller, a spokesman for the Palm Beach County Sheriff's Office. Miller said the alleged violation could be a second-degree misdemeanor. The sheriff's office was investigating and will soon turn the case over to the state attorney's office, which had no immediate comment Tuesday. Under the deal reached last month with prosecutors, Limbaugh was not to be arrested for any infraction for 18 months in exchange for authorities deferring a charge of ''doctor shopping.'' Prosecutors had alleged the conservative talk-show host illegally deceived multiple physicians to receive overlapping painkiller prescriptions. Limbaugh also must submit to random drug tests and continue treatment for his admitted addiction to painkillers. Limbaugh's doctor had prescribed the Viagra, but it was ''labeled as being issued to the physician rather than Mr. Limbaugh for privacy purposes,'' Roy Black, Limbaugh's attorney, said in a statement. U.S. Customs and Border Protection examined the 55-year-old radio commentator's luggage after his private plane landed at the airport, Miller said. Investigators confiscated the drugs, which treat erectile dysfunction. Limbaugh was released without being charged.

No he was not arrested at the airport. The bottle of medication was sent to the Palm Beach DA office (IIRC) for determination if any charges are warranted.

The medication is obviously non-narcotic and the issue would be if the label was the doctors offense, Rush's offense or any chargable offense at all.

Knowing the PB DA, I'm thinking he'll try to drum up something at least for a while.

LOL. I thought social conservatives routinely condemned sex between unmarried people. Or is that only for "lefty" unmarried people? Can you imagine the fur that would be flying if it were x42 who had been stopped at the airport under these circumstances?

The idea of "consenting adults" should not take into account who those consenting adults are.

2 bottles of viagra? How many tabs in each?

For the record - I don't care who Rush is having sex with, the circumstances thereof, his chemical needs for same. Sex between consenting adults isn't anyone's biz now, apparently (unlike a few years ago). {running for cover}

They'll target Rush everywhere he goes, stop and search, detain, all reported in the press over and over. Libs figure enough smoke will convince people there's fire/ Rush is a drug addict not worth listening to. Denigrate and demonize him until his career and his life is destroyed. That way they'll take congress and the WH.

I don't know whether the way this was done between Rush and his doctor was illegal or not, but after having had the anal probe Rush got over the phony doctor-shopping charge, I can't blame him for trying to do something to protect his privacy.

Apparently that can be a risky practice if you are trying to go through customs.

I'll bet customs officials look the other way a lot of other times though...

I don't think a crime has been committed. Rush was just wanted to keep the prescription secret. But, if the last thing the guy need is a media story about a love child or some woman suing him for child support.

He'd be smart to find a fifth Mrs. Limbaugh.

I'm sorry, but Rush takes NO prisoners on his show. But he should be treated with kid gloves? That's not how politics works, even for political commentators. He puts himself into the limelight, makes enemies, and then we're gonna whine if and when he doesn't travel the straight and narrow (unfortunate word choice noted).

I'm no fan of the NYT, but once the Palm Beach County Sheriff's office (and possibly Customs as well) started babbling about this publicly, it wasn't unreasonable for the NYT to figure it was newsworthy. If Rush didn't do anything illegal, wasn't arrested, and hasn't been charged with any crime, what the heck are Palm Beach and/or Customs officials opening their traps for? Somebody's head should roll for this, but not at the NYT (though plenty of heads should be rolling there for other, bigger offenses).

Of all the lessons Rush should have learned from his prescription painkiller problem, moving the Hell out of Palm Beach (and Florida, for that matter) should have been numero uno ("a little Spanish lingo").
