(AP) -- Rush Limbaugh could see a deal with prosecutors in a long-running prescription fraud case collapse after authorities found a bottle of Viagra in his bag at Palm Beach International Airport. The prescription was not in his name. Limbaugh was detained for more than three hours Monday at the airport after returning from a vacation in the Dominican Republic. Customs officials found the Viagra in his luggage but his name was not on the prescription, said Paul Miller, a spokesman for the Palm Beach County Sheriff's Office. Miller said the alleged violation could be a second-degree misdemeanor. The sheriff's office was investigating and will soon turn the case over to the state attorney's office, which had no immediate comment Tuesday. Under the deal reached last month with prosecutors, Limbaugh was not to be arrested for any infraction for 18 months in exchange for authorities deferring a charge of ''doctor shopping.'' Prosecutors had alleged the conservative talk-show host illegally deceived multiple physicians to receive overlapping painkiller prescriptions. Limbaugh also must submit to random drug tests and continue treatment for his admitted addiction to painkillers. Limbaugh's doctor had prescribed the Viagra, but it was ''labeled as being issued to the physician rather than Mr. Limbaugh for privacy purposes,'' Roy Black, Limbaugh's attorney, said in a statement. U.S. Customs and Border Protection examined the 55-year-old radio commentator's luggage after his private plane landed at the airport, Miller said. Investigators confiscated the drugs, which treat erectile dysfunction. Limbaugh was released without being charged.

So it would be okay if his doctor gave him some Viagra samples, like all doctors do when letting you see if the medication works, or there are no reactions before getting a perscription filled?
I doubt the law will come down on the doctor or Rush on this one, but this is Florida, so who knows? Rush is his patient and the doctor got him the Viagra (not a narcotic).

My take is that Limbaugh handled this exactly right by making fun of it. The NYT article makes them look like real lunatics following on the heels of the latest revelation of another of our terror fighting tools.

Don't lump me in with the other moralizers on this thread. If he's having sex outside of marriage, that's wrong, but everybody is a sinner, and I'm not going to point fingers at him. He's not like some of the other examples (Clinton) who had no other redeeming qualities.

Okay, you win. I can't help but think that Rush's decision to move to Palm Beach (scene of the attempted "hanging chad" caper) was as impulsive as the infrequent, but sometimes damaging, "spontaneous" moves Rush has made over the years.
I doubt the people going through his luggage would think so, if they ran across samples of perscription drugs in Rush's suitcase. In fact, I bet they'd make just as big a deal over it.

All of the fuss over this must be very HARD ON Rush. He might be looking at a STIFF penalty. As to his morale, it must be difficult to GET IT UP when so much scrutiny is paid to his every move.
