Rush Limbaugh's Attorney Roy Black Responds to Media Inquiries

MIAMI, June 26 /PRNewswire/ -- Roy Black, Rush Limbaugh's attorney, issued the following statement today in response to several inquiries by the media:
While going through routine Customs inspection of luggage at Palm Beach International Airport upon his return from an international trip, Rush Limbaugh was detained by customs agents after they noticed a non-narcotic prescription drug, which had been prescribed by Mr. Limbaugh's treating physician but labeled as being issued to the physician rather than Mr. Limbaugh for privacy purposes. After a brief interview, Mr. Limbaugh was permitted to continue on his journey.

Anyone not named Rush Limbaugh wouldn't have been detained for a bottle of Viagra and you can sure as hell bet the story wouldn't have been leaked.

First, thank your husband for his service.
Second, I am mad as hell that this has made the news. I think everyday in every way the media is proving themselves to be incredibly dangerous to the citizens of this country. From the New York Times to CBS and every other leftist media outlet, they are out destroy individuals and this country. Enough is enough. There is no reason that this "news" should have been made public.

This does NOT appear to be a case of unlawful possession or use of a prescription drug. It is, if anything, a violation of prescription labeling laws.
If Rush's attorney has accurately summarized the facts, Rush should be in no danger of prosecution. If Rush was dispensed the drug by a licensed practitioner, and the practitioner (or his assistant) made up the label to show that it was prescribed to the practitioner, then the practitioner might get his hand slapped, but Rush should be in the clear. The question as to Rush is whether he was lawfully in possession of the drug. If it was dispensed to him in the ordinary and proper course of treatment by a licensed practitioner, then he almost certainly was in lawful possession of the drug.

If local authorities told customs they had reason to believe he might be carrying drugs on him, customs would detain and search him -- and under the terms of his probation, this prosecutor may do a lot of impromptu searches.
