Has the law changed in the last 5 years? (that's how long I've been retired.)
Back when I was closing Ok loans, the only time both spouses had to sign the docs was when both their incomes were used in qualifying for the mortgage. I closed quite a few Ok loans where the spouse who wasn't used in qualifying for the loan signed no documents at all.
In Texas and in Florida the non-qualifying spouse has to sign the Deed of Trust/Mortgage. I had to stop several Tx. closings after reviewing low income housing files because the applicant would state he was single but then the tax returns would indicate he was married. So, since he was claiming married even if common-law, she still had to sign the DOT.
