A high school student sued his school district after he was suspended for distributing flyers about an off-campus rally against illegal immigration.

Joshua Denhalter, an 18-year-old senior at Jurupa Valley High School, said he sought permission to hold a demonstration after a school assembly turned into a virtual rally supporting illegal immigrants. School officials denied his request, saying a protest could lead to violence.

Denhalter said he then tried to organize an off-campus rally in March and was suspended for three days for passing out flyers about it on school property. He said he also was told he couldn't wear a T-shirt bearing an anti-illegal immigration slogan.

He is scheduled to appear in Riverside County Superior Court Wednesday to ask a judge for a restraining order requiring the Jurupa Unified School District to allow him to hold his rally and wear his T-shirt.

Denhalter's lawsuit claims the district violated his free speech rights and damaged his reputation. It asks for $25,000, an apology from the district, his suspension to be erased, and for the district to acknowledge it was wrong.

The school district in a statement denied Denhalter's allegations, saying a campus forum was arranged at which all students could express their views on illegal immigration. The statement said students don't have an absolute right to free speech "when such speech incites students to break rules or substantially disrupt school operations."

What about the previous rally which incited students to break laws ; i.e. immigration laws. And when is free speech most needed except when one disagrees with the current policy.

I wonder how many, if any, pro-illegal students have been suspended. Also, it would help corner the schools system to ask them if he was suspended for the content of the flyer or for just passing out flyers. I have a feeling the school will not want to answer that one.

First off GIT-R-DUN

Unfortunately for him there is absolutely NO WAY he can win.

This shows you how socialist our school system is. If a school can prove that they prevented him from carrying out such actions to prevent him from disrupting learning, the school wins. NO MATTER WHAT IT IS if the school proves this they win. Tell me this isn't communist.

School--"we couldn't let him say anything that might get in the way of our indoctrination"

This is and example of why the U.S. should not have government schools!

Why?

Because government schools ( and all schools) MUST restrict free press, free speech, free assembly, and free expression of religion. If they didn't chaos would reign. When a government school does this it plops its big fat foot all over the First Amendment.
