Americans, Candians, and Iraqis are waiting for some public

It is interesting that the charges were laid in Peel Region at the west end of the GTA even though the arrests were made across the GTA and the detention facility in Durham Region at the east end of the GTA.

It has been over 25 years but the conventional wisdom then was "the Crown at Peel doesn't deal". The story went that when a defence counsel would ask the Crown what it would accept, the reply was usually "I will accept a plea of guilty".

I explicitly asked the supervising Crown whether that meant more trials and fewer convictions and he told me "no". "We get the same percentage of guilty pleas and the same rate of convictions as other urban jurisdictions."

I am not currently au courant with the Peel Crown but my experience is that institutional practices such as this tend to persist.

Just speculation. Is there anyone here currently familiar with current Peel Region practice?

The arrests were made Friday and Saturday after the group acquired three tons of ammonium nitrate from undercover Mounties in a sting operation, the Toronto Star reported.

Any reliable reports of this canard yet?

I live in Peel & my perception is the exact opposite.
In fact I'd go so far as to observe that it's served as the breeding ground for some of the most biased legal hacks in the province who've later gone to become Head Crowns & Judges elsewhere.

Leo McGuigan (sp?), who was effectively the 'go to guy' when the AG's Office was making its 'deal with the devil' with Karla Holmolka, was also then the long-time supervisor for an area which included Peel.

At least with all of the terrorists being male, you may possibly be on to something since Peel is notorious for gender-biased justice:
When (now Judge) Paul Taylor was Head Crown (under old Leo) he once got into a very public scrap with Mr. Justice Flaherty in open Court (!) over his outright demand that a nanny actually videotaped physically abusing a toddler receive a conditional sentence!

His rationale: nothing beyond her say-so that she'd been an 'abused woman' in her third world homeland prior to coming to Canada !!!

My knowledge of the Peel Crown is hopelessly old, Clive, but I do remember that CFB Borden up the road a bit had a useful group of SAS lads that were loaned-out on occasion to deal with the hardcases.

Probably accounted for some of those guilty pleas................FRegards

The version that I heard is that the Horsemen substituted an innocuous substance in 25 kg ammonium nitrate bags and delivered the substitute in place of the ordered ammonium nitrate.

BTW: Canada still follows the common law respecting agents provocateur. It is not entrapment unless the subject of the sting is Incited or induced to do an unlawful act that he otherwise would not commit. It is perfectly lawful for the agent provocateur to facilitate an act that the subject had a prior intent to commit.

This is really no different from a drug buy or sale between an agent provocateur and a drug dealer that is routine practice throughout the common law.

There were bound to be terrorist cells in Canada as in other parts of the world. What amazes me is that when you read posts such as those to the G & M, the liberals are in denial. These terrorists had enough explosives to kill thousands of innocent people and everyone, whatever their political persuasion, should be very grateful that they were caught.

As I have said, it is at least a quarter century since I had any dealings with the Peel Crown.

Pity! I rather enjoyed the old attitude.

But then I have some very old fashioned attitudes. I always maintained that things in Toronto got really boring after the holdup squad guy with the rabbit suit got promoted to Chief Superintendent.

The fight against terrorism will be long and arduous and only when the perpetrators discover that terrorism doesn't work will terrorism be defeated. When the slow learners on the liberal side of politics learn this lesson, the fight will be made a little easier.

Any reliable reports of this canard yet?

From what I've been following, the suspects

  1. Made an order for 3 tons of AN
  2. This naturally caused some interest
  3. The cops delivered fake AN
  4. and arrested them after delivery
As long as the cops just made the delivery, and in no way induced the suspects to make the purchase, there is no entrapment.

I seem to have read the same stuff as you guys:
1. Those reports (CNN,Yahoo, etc.) which refer back to the article in the (Red) Star which states only that "Sources say investigators who had learned of the group's alleged plan to build a bomb were controlling the sale and transport of the massive amount of fertilizer, a key component in creating explosives." and
2. A comment in the Globe and Mail article about the RCMP pulling a switcheroo.

That's it! No details. No "anonymous RCMP official". Just gossip.

Hope I'm not being obtuse, but let me rephrase my question:
Seen any reliable reports of this canard yet?
