WASHINGTON - Rep. Patrick J. Kennedy, D-R.I., denied through his office Thursday that he had been drinking before he crashed a car into a Capitol Hill security barricade at 2:45 a.m.
"I consumed no alcohol prior to the incident," he said in a statement. "I will fully cooperate with the Capitol Police in whatever investigation they choose to undertake."

Even assuming this point is true ...
In most states you can get a DUI for being under the influence of any chemical that degrades your reflexes, alertness, or judgement. It doesn't have to be alcohol.
Whatever.
If you can get away with a dead woman in the backseat, you can certainly get away with this.
I believe some local bar employees have already come forward to dispute that.
Also, it depends on what the meaning of PRIOR is. Like, 2 seconds prior, 5 minutes prior, 1 hour prior???

Unfortunately for Kennedy, there were witnesses including a bar hostess at the Hawk & Dove Bar who saw him drinking prior to the incident. He is toast. Kennedy must have been so drunk that he forgot he was in Washington and not Rhode Island or Massachusetts, where people lie and cover his sorry butt.

Well....in that case the bar owner could become responsible (only a Kennedy).....serving drinks to a drunk is against the law in most states...anyway, it is in Texas.
Kennedy was speaking of having no drinks in the car just prior to his accident. He's just being clintonesque in selecting his own starting point for the sequence of events. After all, a drink last week is prior to the accident, isn't it?

And how is it supposed to be somehow better that he was incapacitated by drugs rather than incapacitated by alcohol? It's still illegal, no matter what substance was being used or abused. I can't believe the Kennedy lawyers let him make a public statement admitting that he broke the law by driving impaired by any substance.
This is a double standard case.
