Ruling on a 15-year-old ACLU case, a federal judge today ordered the city of San Diego to remove a mountain-top cross within 90 days or face a fine of $5,000 a day.
U.S. District Judge Gordon Thompson said, "It is now time, and perhaps long overdue, for this court to enforce its initial permanent injunction forbidding the presence of the Mount Soledad cross on city property," the San Diego Union-Tribune reported.

Judges our the lawmakers of the 21st century, they know better what is good for us than what we do,
they are appointed to protect us from the harm we would do to our selves if it were not for them!
Different cross different area.
Mt. Helix has a cross on top in the La Mesa area, east of the City of San Diego
Mt. Soledad with the Cross (the cross in dispute)
is in the La Jolla area of San Diego over looking the ocean.
The homes in that area go for mega millions.

Can't they just declare this illegal cross an undocumented cross and ignore the law?
I would assume the US Treasury. But if Congress would pass a law that would reimburse the city for any fines paid, it would effectively negate the ruling.
The activists have basically done away with that pesky old 10th Amendment.

The ACLU came all the way up to a small town in central WI and tried to force the good folks there to take down their statue of Christ (next to the edge of town on Main street)...that read "Christ Guide Us On Our Way"

It wouldn't surprise me if he ordered the installation of a crescent.
The cross you are talking about is on Mount Helix, another is in downtown La Mesa and now belongs to The American Legion, it is also by the way the very first permanent VietNam memorial in the United States, which was transferred by the city
Perhaps this judge should be fitted for tar and feather finery and be given a free ride out of town on a thin wooden fence part.
This was what was approved by a voters referendom, transfer the memorial to the federal gov, National Parks, a single @ssclu judge said this is not ok
