Justice Thomas keeps the flame
townhall.com ^ | Apr 27, 2006 | Review By Dutch Martin

Clarence Thomas is arguably the most controversial United States Supreme Court Associate Justice in modern times. This is not because of his jurisprudence, which strictly interprets the U.S. Constitution based on the original intent of its drafters; it’s not because of the meticulous way in which he relies on the Constitution’s text, context, history, and timeless principles of natural law in examining each Supreme Court case that comes before him. ......

... Justice Thomas is controversial for mainly one reason: He is a black conservative jurist who sticks to his guns and stands by his convictions. As a result, the vicious character assassination leveled against him by the liberal elites and the civil rights establishment over the past 15 years has spurred another conservative lawyer into action. The result is a must-read: The Keeper of the Flame: The Supreme Court Opinions of Justice Clarence Thomas (1991-2005). .....

.....Author Henry Mark Holzer, Professor Emeritus at Brooklyn Law School, examines all 327 opinions – majority, concurring and dissenting – written by Justice Thomas during his 14 complete terms on the High Court. ...

Another quote from the review:

....As Professor Holzer observes, “I cannot count the times that people who should know better [i.e. legal scholars and other “learned” people] have, simply upon hearing Clarence Thomas’s name, immediately responded with derogatory comments about his abilities as a justice – even though they have never read a single opinion of the [327] Thomas has written.” I challenge anyone to come away from reading The Keeper of the Flame and continue to view Justice Clarence Thomas as anything but the brilliant, articulate constitutional originalist that he is.

I think Prez. Bush should sit down and have a long, long talk with Justice Thomas. Then maybe Bush will understand what it means to be a true American - not a pandering globalist.

Agreed! Thomas and Scalia have distinguished themselves as being Justices that Publius and the boys would be proud of.

1000 years from now, when a single paragraph is written in the history books about this time, I wonder whose name will be mentioned. I have for a couple of decades assumed it would be Ronald Reagan.....Could it be Justice Thomas? Will his "one-man-stand" for Constutitional Government, in hindsight, be the most significant event in the maintenance on civilization? If Constitutional government is not maintained by us, then who will maintain it???

Who knows....there are lots of patriots out there, and GW may yet make an appointment or two.

Here's the Amazon page with four 5-star reviews. I'm going to procure a copy!

And George Bush, Sr., for all his shortgivings, sure did this one thing right. Thanks, Mr. Bush for your service to our country.

As a mental health professional, I am swamped in a sea of leftists. Over the past 20 years, it has ocurred to me that the only racist language I hear is from White reactionary liberals. It is often, but not always, directed at Black conservatives and Black Republicans.

My guess is that leftists believe that Blacks are inferior because it justifies their cries for more government programs and bureaucratic jobs. Blacks who succeed in private industry are anathema to the socialist left, particularly if they are outspoken conservatives.

Did you forget? President BUSH appointed Justices Alito and Chief Justice Roberts, two great men to the United States of America and its highest court.

It was my fervent hope that the President, when he had the opportunity, would nominate Mr. Justice Thomas to be Chief Justice. Alas, "W" is not as conservative as many people believed him to be...

What is wrong with Chief Justice Roberts?

he's still giving our country away...

look at what he's done today with the new Dubai company...

He is week on immigration. He's not concerned with the future of this country. If he is, he's not showing it by not listening to the pulse of this country.

I voted for Bush twice. He was given a mandate this second term and he's screwing it up. My opinion.

He's still better than John Kerry or Al Gore!

Although I agree W has dropped the ball on other important issues, your comment has nothing to do with the discussion at hand regarding SCOTUS, Thomas and W.

What is wrong with Chief Justice Roberts?

As with every other high court justice, 'only time will tell' with Roberts. If he is as much an originalist as Thomas has proved himself to be, I will be satisfied. If he is even more of an originalist than Thomas, I will be overjoyed. If I see him siding with a 'liberal' majority, as Rehnquist did from time to time, I will continue to suggest that Thomas would have been a better choice.
