New York will have to prove intent on the part of the retailer to make an illegal sale with foreknowledge that it would be handed over to an ineligible person. If they can prove the straw sale, the felonious actor is the person to passed the firearm to the ineligible party...not the retailer. Once a purchased product leaves the premises of a retailer, it is the responsiblity of the new owner to use that product in a legal fashion. New York is tilting at windmills again. The sorry consequence is that some firearms dealers will be bankrupted in the process of defending against an unjust accusation. They will be forced to pay the costs from their personal assets while the prosecution/persecution is financed by the taxpayers in New York City.
It would be justice to have the retailers win the case and force that asshole Mayor Bloomberg to personally pay the costs of his public vendetta against gun owners and retailers.
