A proposed bill giving local law enforcement agencies the ability to stop, question and arrest illegal immigrants as trespassers is a "recipe for disaster," said Yuma County Sheriff Ralph Ogden.
It will create a "ripple effect" on the jail, records department, county attorney and court system, Ogden said.
"Both for the officer on the street and the officer in the jail that will incarcerate the trespassers," Ogden said in a letter to Gov. Janet Napolitano. "This legislation represents an enormous unfunded obligation for state, county and local law enforcement ... I strongly urge you to veto this bill if it comes to your office."
Wednesday, the Senate voted 17-12 to say that people who violated federal law by entering this country without permission can be charged and convicted under state law with trespassing, whether the person was on public or private property, with or without the permission of the owner.
House members followed suit less than an hour later on a 33-27 vote. Yuma representatives were in the minority, all three voting no on the bill.
"No one along the border wants this bill," Sen. Robert Cannell, D-Yuma, said. "They have enough to do without arresting people for being here illegally. It's a bad bill and I hope it gets vetoed."
And it looks like that might happen.
Napolitano has received more than a dozen letters from law enforcement agencies and prosecutors around the state urging her to veto the measure.
"I listen very closely where law enforcement is,'' she said, according to a Capitol Media Services' article.

I am ashamed to live in the state of Arizona with any of the above mentioned socialists.
But these law enforcement folks have no problem stopping and harrassing honest US citizens.
Don't be ashamed of living in Arizona. Be very ashamed that people like McCain and Napolitano keep getting elected in Arizona.
Betcha a five dollar bill that me, as one of "We The People", committed any kind of crime in his county I would be slammed.
When it gets to the nut cuttin on the immigration issue the government from top to bottom will side with our enemies.

Sheriff Ogdan is obviously in on the conspiracy with Bush to destroy America.
Ralph Ogden used to be a friend of mine. He is a fine man and a good sheriff. I lived in Yuma for many years and you won't find an easier man to deal with or a better run department.
That being said he is a Democrat. Yuma is a small enough city that I also count the publisher of the Yuma Sun, Sam Pepper, as a former friend. The Sun is a far left paper. Read anything in it with extreme scrutiny. Sam's uncle was Claude Pepper, the former Florida congressman that JFK once called "Red Pepper." Sam is a really good guy aside from politics, as is Sheriff Ogden.
Yuma is more on the front lines of this issue than Tucson, where I now live. Algodones, Mexico is five miles one direction and San Luis, RC IS 22 miles away another direction.
Arresting illegals for trespassing was attempted by a few local police chiefs in New Hampshire. Originally the trespasser pled guilty, but then the Mexican Consulate and ACLU got involved and brought in lawyers. The plea was withdrawn and a trial ensued. The people lost. Illegals are free to trespass in NH. The only remedy is to call the ICE down in CT. Sometimes they show up to take custody; sometimes they don't and the illegal is set free.
But these law enforcement folks have no problem stopping and harrassing honest US citizens.
No, these Chief Wiggums-clones want to enforce the local leash laws instead - because dogs on the loose are more important than illegs on the loose!
This is where it starts, the looking the other way by cops who want to run speed traps to raise money for the policeman's ball. I hope the people of Arizona will insist.

I have sent two bricks. Cost is reasonable. $5.00 each with flat rate U.S. Postal envelope includes signature confirmation and on-line tracking. Wrap the brick in cardboard, tape it shut and attach a letter (or not). I sent one to Frist and one to Hastert and plan on sending more to my legislators. And I may even do it more than once.
Not true. My border county Sheriff (Larry Dever, Cochise County) endorsed the measure. Don't have a clue what Yuma's problem is....

I believe The Sheriff's problem is noone will answer where the money is going to come from. The county Jail is already full with the druggies and the robbers.
The City of Yuma has been silent on this but they've got about 90 badges (maybe less) so what do you have them stop doing in order to do this?
The gov is good at saying she's gonna do things but not providing the funds.
The real obstacles in this issue are in DC, not Yuma.

Moreover, if municipalities misused the sanctioning power of the FDIC in improper ways, to fraudulently engage in illegal activity using government funds, that should be pursued with the FDIC.

These activities might also violate The Hobbs Act if public officials are aiding and abetting illegal activities, and not enforcing state and federal laws----The Hobbs Act covers extortion by public officials, as follows: 2403 Hobbs Act -- Extortion By Force, Violence, or Fear. The Hobbs Act regulates extortion and robbery, which Congress has determined have a substantial effect on interstate and foreign commerce by reason of their repetition and aggregate effect on the economy. Therefore, the proscribed offenses fall within the category of crimes based on the Commerce Clause whose "de minimis character of individual instances arising under [the] statute is of no consequence."
If duly elected federal, state, county and municipal officials, under oath of office, are aiding and abetting illegals:
to break US laws,
to take money under the table,
to not report tax implications,
to aid and abet accounting fraud;
to obtain the unlawful right to vote in our elections,
to ignore illegals phony documentation, and,
if elected and appointed officals did, in fact, allow illegals to break the law to serve on official municipal councils, and if illegals are making monetary (taxing) decisions for U.S. citizens, and, if elected and appointed officials took campaign contributions from said illegals, and in the process, deliberately ignored US laws, this could be characterized as extortion, and/or bribery, and a violation of the Hobbs Act.
Primary investigative jurisdiction of offenses in 18 U.S.C. § 1951 lies with the FBI. The Inspector General's Office of Investigations, Division of Labor Racketeering(formerly the Office of Labor Racketeering), United States Department of Labor, is also authorized to investigate violations of 18 U.S.C. § 1951 in labor-management disputes involving the extortion of property from employers by reason of authority conferred on nvestigators as Special Deputy United States Marshals. Supervisory jurisdiction over 18 U.S.C. § 1951 is exercised by the following offices with respect to the offenses noted:
1. Extortion under color of official right or extortion by a public official through misuse of his/her office is supervised by the Public Integrity Section, Criminal Division.
2. Extortion and robbery in labor-management disputes is supervised by the Labor-Management Unit of the Organized Crime and Racketeering Section, Criminal Division.
3. All other extortion and robbery offenses not involving public officials or labor-management disputes are supervised by the Terrorism and Violent Crimes Section, Criminal Division.
