CA: Private property group endorses ballot act

The California Alliance to Protect Private Property Rights endorsed "The Homeowners and Private Property Protection Act," sponsored by Senator Tom McClintock, Assemblyman Doug LaMalfa and the Howard Jarvis Taxpayers Association on Friday.

The ballot measure has companion bills before the State Legislature. SCA 20 and ACA 22 are sponsored by Senator McClintock and Assemblyman LaMalfa, respectively.

As a result of the U.S. Supreme Court's Kelo v. New London decision, nearly every state in the country is considering legislative reforms, including California. However, California private property rights activists have not been assured that meaningful reforms will be passed by the California State Legislature. Last year, no reforms were considered on the Senate and Assembly floor and this year, a vote on SCA 20 and ACA 22 has yet to be announced.

Property rights advocates are confident that at least one eminent domain ballot measure will qualify for the November ballot. Four measures were submitted for chapter and summary.

"If the California State Legislature fails to enact reforms soon, California voters will have an opportunity to pass a state initiative that prohibits government from profiting by seizing property from one property owner and selling it to another," said Marko Mlikotin, president of the Alliance. "The U.S. Supreme Court's Kelo v. New London decision was a wake-up call for homeowners who falsely believed their home is their castle."

This month, the Alliance launched a campaign urging members of the California State Legislature and county supervisors to sign the "Hands Off My Home Pledge," a national program of the Castle Coalition. The letter and California pledge can be found on the Alliance's Web site. Those taking the pledge will be posted on the Web site in the coming weeks.

The Alliance was founded by Yolo County farmers and taxpayer advocates challenging Yolo County's use of gambling profits to seize the Conaway Ranch. They are a statewide organization dedicated to exposing the abuses of eminent domain in California and are working with State and Federal legislative representatives to provide new protections for California's homeowners, small businesses and family farms.

SCA 20, a proposed amendment to the California State Constitution troubles grassroots groups such as LucerneFLOW and FeltonFLOW, near Santa Cruz.

The amendment was introduced by state Sen. Tom McClintock, R-Thousand Oaks. It's important to the community groups because it would, among other things, prohibit the use of eminent domain if the property were to continue the same use under a new owner.

The bill is in the Senate Judiciary Committee, chaired by Joe Dunn, D-Garden Grove.

The Howard Jarvis Taxpayers Association has filed the California Property Owners Protection Act and is waiting for the "Title and Summary" to be prepared by the California Attorney General before signatures can be gathered.

It would allow property to be taken only for truly public uses, such as for roads or public buildings, and would prohibit government from taking property only for economic development.

While grassroots representatives generally agree a recent Supreme Court decision allowing the exercise of eminent domain to acquire private property and turn it over to commercial interests is faulty, they see SCA 20 as a danger to the common good and would like to see water companies specifically excluded.

The newly established California Alliance to Protect Private Property Rights announced that former state Senator and minority leader Jim Nielsen of Woodland was elected to serve as chairman of the board. Serving as the organization's "honorary" co-chairmen are Senator Tom McClintock of Ventura County and Assemblyman Doug LaMalfa of Butte County.

What kills me is that people will start a whole new organizaiton rather than just use one that has been around for ever. Think what we could do if the people who are backing this...well you know.

I'm not sure what's up with the casual (ie., not political junkie) conservatives in California. Sometimes I wonder if they look at the complete scumbags who are running things in Sacramento and "representing" them in Washington DC (goofball socialist scumbags who keep getting reelected, by the way) and figure it's a hopeless cause. Then they see the state GOP running to the left like scared, pandering weaklings and maybe many of them have decided to just give it up and try to get by as best they can. That's sure the way it looked during the last ballot measure campaign.

They call it "local control over water." It is an effort to take over all private water systems by eminent domain.
