US judge refuses to dismiss Moussaoui trial

A US judge declined to dismiss the death penalty trial of September 11 plotter Zacarias Moussaoui, but dealt a huge blow to the prosecution by throwing out key evidence.
US District Judge Leonie Brinkema said the case could continue but dealt a stinging rebuke to the government, saying "I don't think in the annals of criminal law there has ever been a case with as many significant problems."
Brinkema's ruling came after a controversy over apparent witness coaching by a government lawyer which the defense said prejudiced Moussaoui's chances of a fair trial.
She struck out all testimony from witnesses having to do with aviation issues, which the prosecution had said made up half of its case against Moussaoui.

Sorry I think I misunderstood ya. They are permitting the testimony of the others who have already testified, just not the "coached" witness?

But Judge Brinkema said that she was "an attorney for the United States and you all represent the United States. It's not the Justice Department against Mr. Moussaoui, it's the United States" that is trying to have him executed.

The witnesses, all government aviation safety officials, generally testified today that nothing in the coaching from Ms. Martin would have changed their testimony and some described her as a nuisance who wasted their time. But as they testified in detail about their contacts with Ms. Martin, Judge Brinkema seemed increasingly exasperated.

A lawyer who is a nuisance and a waster of people's time. Don't know too many of those kind. LOL!
Yeah ... I knew that. It's just difficult to use Judge and Her in the same sentence without thinking of Judge Judy :)
It's the same as when one agency of the federal government seeks to disavow a deal made by another agency. The extensive case law say that's there's only one United States government and that a deal with one agency is a deal with all. The theory is the same in this case.
For any 9-11 families that are reading this forum:
The government knows about a witness that saw Moussaoui with Atta but they would rather lose the death penalty case than bring this witness forward. Here is the link to the article when it was posted on Free Republic.

I have met this hotel owner and he is very credible. The FBI tried to tell the Oklahoma County Grand Jury that he had changed his story. He has never changed his story. The FBI has gone out of their way to try and discredit him. They will not bring him up in the Moussaoui trial because if they give him credibility in the Moussaoui trial, they give him credibility in the Oklahoma City bombing case.
The 9-11 families long ago should not have listened to their government "handlers" on the connection between 9-11 and the Oklahoma City bombing. I am sure that they were told things like witnesses "changed their story" and other lies to keep them from pursuing the truth. It is probably too late now.
