I see it as a free marketDid you see it as a free market when unelected bureaucrats and "non-profit" gangs with an agenda took away the rights of private property owners to allow legal activity on their premises?
Or does the free market theory only come into play when 93-year old women should just haul ass and get out if they don't like it?

I saw it as politicians should not be allowed to infringe on restaurant/bar owners rights to have a smoking facility if they want to. We lost that battle. (at least in Calif., a long time ago)
Now if smoke is classified as a hazardous material, then you have worker safety issues. i.e. coal miners. The mine owner doesn't get to do anything he wants to regarding work conditions. So once smoke is classified as a hazardous material, all bets are off.
