I saw it as politicians should not be allowed to infringe on restaurant/bar owners rights to have a smoking facility if they want to. We lost that battle. (at least in Calif., a long time ago)
Now if smoke is classified as a hazardous material, then you have worker safety issues. i.e. coal miners. The mine owner doesn't get to do anything he wants to regarding work conditions. So once smoke is classified as a hazardous material, all bets are off.

The concentrations necessary were impossible to achieve.
That little bit of scientific impossibility didn't stop the anti-smoking Nazis.
