"If we only had the British system where the plaintiff, if they lose, must pay legal fees and damages to the defendant if they don't prevail.
That would not help in this case. If SCO loses, they will have no assets left to pay for anything.

I always thought it was a heck of a coincidence that MS suddenly decided they needed contracts with SCO right about the time SCO needed a cash infusion to continue their lawsuit.

Yup.
Among other metrics:
Microsoft is #41 on the Fortune 500.
IBM is #10.

While I wish them well, hasn't IBM already lost? Their plans for a big Linux push has been stalled in court for 3(?) years with no real end in sight.
I believe that Microsoft engineered and financed the whole stall and that IBM stands little chance of recovering anything from those responsible.

Now it appears that IBM wants to play the same game. I'm pretty sure that IBM is the defendant, not the plaintiff. I can't fault them for defending themselves and their business strategy from someone who files a lawsuit. Especially if Microsoft is so willing to dump money into a dying company to see the lawsuit continue.

Hmmmmm...
If IBM can prove that Sun/Microsoft/???? colluded in some illegal activity to suppress or hinder IBM's legitimate conduct of business ---- Does that open up Microsoft's "deep pockets" to a ravaging raid by IBM?

I do believe that he was one who thought SCO had a legitimate shot at winning this.

I find it really amusing to watch people pick sides and act like there's innocent parties in this whole mess.
These companies have been all been using bogus lawsuits and deceitful spinning about disagreements for decades.
They are all guilty of doing it. There's multiple examples of each of them doing it.

That would be my guess - and I think that may be their strategy, too.
