SPOTSYLVANIA, Va. -- Undercover sex is getting the OK from a Virginia sheriff.
Spotsylvania County Sheriff Howard Smith said he stands by the practice of allowing detectives to receive sexual services in the course of their investigations so they can catch suspects in the act.
Court documents show that four times last month, county detectives allowed women at a massage parlor to perform sex acts on them. In one case, a lawman left a $350 tip. Smith acknowledged the practice is not new.
Smith told The Washington Post that only unmarried detectives are allowed to do the under-the-covers work.
He said actual sex acts are needed to help win prostitution convictions.
"If I thought we could get the conviction without that, we wouldn't allow it," Smith told the newspaper. "If you want to make them, this has to be done."
He said most prostitutes are careful not to say anything incriminating, which makes sexual contact necessary
Several police officials and legal observers say the practice has been tried by other agencies across the country, but they knew of none that still permit sexual contact with suspects as part of prostitution investigations. But many police agencies across the country have banned sexual contact between investigators and suspects.
When police used similar tactics in the past in Montgomery County, Md., the charges ended up being dropped.
Unless he wants to make sure all the cases get thrown out of court.

The Spotsy Libertarians poisoned me on the party forever. I had been all gung-ho, we'll take the country back for the Constitution one precinct at a time, then I went to the official meeting and wasted several hours of my life listening to the need to end all drug laws. That was the ONLY topic of conversation. On second thought, I guess it wasn't a waste - now I know what they really stand for. You can call it bashing if you like.
Because that's exactly what it was. You had no idea that this person was a Libertarian, but figured he was because he ran as an "I"---despite overwhelming evidence of acting like an anti-Libertarian while executing the duties of his office. You just wanted to sound off. Pretty stupid.
There are a LOT of Libertarians in Spotsylvania. If the guy's not a Dem, not a Rep, it's not at all unreasonable to think he might well be a Lib. In Spotsy, there's zero chance he's a member of any variety of Socialist party.
That's great. As a closet libertarian, then, I figure his next big law enforcement initiative would be to have all of his deputies smoke weed with pot dealers, so they could put all the low-level pot dealers behind bars on federal drug charges. And seeing how he's such a stealth libertarian, I wouldn't be a bit surprised if he involved the DEA as well. In fact, he probably has John Ashcroft's number on speed dial---being such a libertarian and all.
Then after he rounds up all the pot dealers, he'll go after all the porn purveyors.
