U.S. Citizen May Be Handed Over to Iraqis

WASHINGTON - The U.S. government wants an Iraqi court to handle criminal charges against a naturalized American citizen who is being held in Iraq on suspicion that he is linked to insurgent leader Abu Musab al-Zarqawi. The man's lawyers said he is innocent and likely to be tortured if he is handed over to the Iraqis.

Shawqi Omar, 44, who once served in the Minnesota National Guard, has been held in U.S.-run military prisons since his capture in 2004.

The government said Omar was harboring an Iraqi insurgent and four Jordanian fighters at the time of his arrest and also had bomb-making materials.

Omar's family said he is a businessman who was seeking reconstruction contracts in Iraq. He also has not had access to a lawyer or been formally charged with a crime since he was taken into custody, said Jonathan Hafetz, an American lawyer representing Omar's family.

Separately, Omar, Zarqawi and 11 others also have been indicted by a Jordanian court on charges they plotted a chemical attack against Jordan's intelligence agency.

Omar's family is asking a U.S. judge to step in and force the government to charge Omar with a crime or release him. U.S. District Judge Ricardo Urbina last week issued an order in Washington temporarily blocking Omar's transfer to Iraqi custody. The order is set to expire on Monday, but the judge could extend it.

The Justice Department weighed in on Tuesday, arguing that Urbina has no business intervening on Omar's behalf and denying that Omar is even in U.S. custody.

That was my thought as well. Apparently this family doesn't know that treason is reason for death by hanging or firing squad.

That'll give some of them reason to pause - our courts are too lenient with them. Iraqi courts and prisons might be a bit strener...

Agreed. If this punk really is helping the savages who are killing our boys (and yes, they're his too) over there, then he should be sent to hell. Just my opinion.

With all due respect, I'd suggest you think this through a little further.  I agree with Kentj, specifically, the phrase "Shock his testicles until they smoke" springs to mind.

Well for sure, according to the America last trash crowd, you don't want him to be jailed and prosecuted by our military or our courts because sure as you know what "stinks" he will be tortured, dehumanized and made to confess to all real or made up charges!

Hmmmmmmm...

Have we YET seen a Muslim terrorist, Muslim spy, Muslim murderer of a non-Muslim or ANY Muslim guilty of a death sentence offense "by our standards" -- EXECUTED by a Muslim "legal system"....

The only "executions" by Muslims that I'm aware of -- are the "executions" being carried out by the terrorists or Muslims against those that oppose THEM...

If the "Good Guys" have executed any of the "Bad Guys" - I would like to start hearing about them....

If he clearly obtained citizenship by fraud, he is not a U.S. citizen.

Perhaps, since he's an American "citizen" they will be more likely to execute the bastard...

To date - I'm unaware that ANY terrorists, spies or murderous bastards taken prisoner have been executed.

Four Jordanian fighters. I wish I had that bit of information when I was in an argument with a liberal in my office a few months agao who claimed the Insurgents were all Iraqi's who were just fighting off an invading army, the same that we would do. My Nephew who returned from Iraq with the Stryker bregade said most of the insurgents are from outside of Iraqi, just as this story suggest.
