CA: Failed parental notification measure could be back before voters ('Prop 73' redux)

SACRAMENTO (AP) - Backers of a failed special election measure that would have forced doctors to notify parents or guardians before performing abortions on underage girls are circulating petitions to have Californians vote on nearly the same measure next November.

Like Proposition 73, the initiative would require a girl under 18 to wait 48 hours after a parent or legal guardian is notified of her intention to get an abortion. Secretary of State Bruce McPherson on Monday cleared supporters to begin gathering signatures.

Voters rejected Proposition 73 by 53 percent to 47 percent during the Nov. 8 special election, when all eight ballot measures were defeated. It was the first abortion-related measure ever to qualify for the California ballot.

Albin Rhomberg, a spokesman for the Parents Right to Know and Child Protection initiative, said the special election wasn't representative of the California electorate because unions and Democrats mobilized supporters to turn out against the four measures promoted by Gov. Arnold Schwarzenegger. The parental notification measure was not part the governor's failed "year of reform" agenda.

"The turnout was very high in the liberal areas of the state and surprisingly low in some of the more conservative areas," Rhomberg said. "It would be foolish to not put it before the voters in a larger general election."

Statewide turnout for the special election was 50 percent of California's registered voters, higher than expectations.

Kathy Kneer, president of Planned Parenthood Affiliates of California, which led opposition to Proposition 73, said minor wording changes on a new initiative aren't likely to change anyone's mind.

"We'd rather be spending our time and resources preventing teens from getting pregnant in the first place. Isn't that more important?" Kneer said.

She said Planned Parenthood won't campaign against the proposal unless the measure qualifies for the November ballot.

Rhomberg's group has until July 3 to gather nearly 600,000 signatures of registered voters.

Like Proposition 73, the initiative would require a girl under 18 to wait 48 hours after a parent or legal guardian is notified of her intention to get an abortion.

For clarification, Prop 73 only required a doctor to wait 48 hours from the attempt at parental notification (such as the certified mailing of a notification), not 48 hours from the receipt of such a notification, before the doctor could abort the baby of the minor patient.

Under Prop 73 rules, it would be possible for girls to get abortions without their parents ever knowing by having other people answer the doctor's notification phonecall or by signing the certified mail receipt themselves. Of course, girls could also have judges grant permission to exempt them from the notification requirement. The anti-73 ads tried to portray prop 73 as forcing pregnant girls to get unsafe abortions to avoid the notification step, but obviously prop 73 has safeguards.

Prop 73 was a great idea, and I hope this new version passes.

In the November 8 special statewide election, over $250 million was spent on the eight ballot initiatives, and they all lost, most by large margins. But the one that came the closest -- within 5.8 percent -- spent the least of all groups for and against. The Yes on 73 committee promoting the Parents' Right to Know and Child Protection initiative spent about $500,000; the No forces spent about ten times this amount, approximately $5 million. This meant a series of TV ads for the No side, none for the Yes forces.

And yet even if the Yes on 73 side could have afforded TV, such money may not have helped. According to sources, for example, in the Los Angeles archdiocesan paper, the Tidings, the "Schwarzenegger referendum effect" may have doomed passage of Proposition 73. The governor's measures and the special election were so unpopular, 73 could not have won, according to political analysts at different sites on the internet.

But this hopelessness gives the Parents Right to Know backers hope. On Wednesday, November 30, the Yes on 73 proponents filed virtually the same initiative with the secretary of state to put Parents Right to Know on the ballot for next November 2006.

The measure will require an abortionist to notify at least one parent of an under-18-year-old before performing an abortion on the girl.

Without the Schwarzenegger effect, with a reinvigorated grassroots effort, and with media materials developed at the end of the last campaign, the Yes forces expect to win next November. The more effective grassroots efforts at gathering signatures will help save enough money for TV ads, sources close to the campaign say.

The campaign materials which came in October, only weeks before the November 8 election, include video clips featuring Patrick Warburton of Seinfeld and Kerri Caviezel; radio spots by Ben Stein, Dr. Laura, Robert Davi, and Laura Ingraham; and a page showing taped conversations with each of 90 abortion clinics around the state (see accompanying article).

Have you heard of stories where the mother of the boyfriend will accompany the girlfriend to the abortion clinic to get one?

Also, have you heard of these same type of moms (parents) going on trips out of town with the boyfriend and the girlfriend. One set of parents usually things all is well however the other set of parents are irresponsible? (I've known of where the girl return pregnant)

Sounds good to me. Get it passed and let the new Supreme Court eventually get the case!

I can completely see that happening.

I currently am aware of one parent of a 14-15 year old who takes her daughter & their friends to rated R movies (like "SAW'" and "SAW 2"), as well as allowing them to go to punk & other concerts unaccompanied.

I've also heard of parents lying to other parents about what the goings-on will be on weekend trips to get the resistant parent to let their teenager attend.
