Alito splits with conservatives on first case Votes to stop Missouri from executing killer contesting lethal injection WASHINGTON - New Supreme Court Justice Samuel Alito split with the courtÂ’s conservative wing Wednesday night, refusing to let Missouri execute a death-row inmate contesting lethal injection. Alito, handling his first case, sided with inmate Michael Taylor, who had won a stay from an appeals court earlier in the evening. Chief Justice John Roberts and Justices Antonin Scalia and Clarence Thomas supported lifting the stay, but Alito joined the remaining five members in turning down MissouriÂ’s last-minute request to allow a midnight execution.

This is wishful thinking on their part. We don't know what this means. We don't know if he's so careful that he needs to review the case first, although his demeanor in the hearings would support this idea. We don't know if this means that he is so pro life that he would not only be against abortion but also against the death penalty, but that's inconsistent with how he presented himself... He presented himself as a careful jurist who holds his personal views apart from the legal decision whereever possible

Don't forget the right wing ones either , who are screaming "betrayal".

All this does is that this goes back to the 8th circuit, which wanted to rule on this case, and then it will probably go back to SCOTUS.

But he was high on crack cocaine (that presumably noone forced him to take), he must be excused for kidnapping and murdering a child!!!

Jeez. If this defense goes through, then anyone who kills another person in a DUI should go scot free!

They usually do, with limited jail time any way.

This is also an admission that there are only three conservatives on the court since it was a 6-3 vote. How could the MSM let that one slip out?

If "Pro-life" means no death penalty, I could live with that.
I believe that "It is good to fear the sword of the state, for it has it's purpose."
But, going through 15 to 25 years of appeals before execution, kind of loses its correlation.
As long as he rules against abortion and euthenasia cases, I'm fine with that.

Some, like me, would say there is more of a case for execution since the person obviously has no control over themselves, and they have killed innocent people.

Exactly. Seems to me he would like to at least review the case before he lets the man be put to death. He's only been on the job a couple of hours.

I would imagine allowing the state to do as it sees fit would have been a states rights issue to since murder and its punishment constitutionally should be left to the states.
