Alito Opposes Mo. Execution

WASHINGTON (AP) - New Supreme Court Justice Samuel Alito split with the court's conservatives Wednesday night, refusing to let Missouri execute a death-row inmate contesting lethal injection.

Alito, handling his first case, sided with inmate Michael Taylor, who had won a stay from an appeals court earlier in the evening. Chief Justice John Roberts and Justices Antonin Scalia and Clarence Thomas supported lifting the stay, but Alito joined the remaining five members in turning down Missouri's last-minute request to allow a midnight execution.

As I understand it, this is just a temporary delay. I think AP is just trying to make trouble.

THIS IS NOT CORRECT!

It was a 9-0 decision.

More than likely, he did not have sufficient time to review the case and chose to stay the execution to give him time to do so.

It is common to make otherwise fireable mistakes on your first day at work (depending on the job of course).

Thank you, I thought that was what I remembered. So it's not only a temporary delay, but the vote was 9-0.

AP and Drudge just trying to make trouble, as usual.

Boy, does that tick me off!

When I was driving home this evening, the news on the radio was reporting this as a 9-0 decision. Curious.

"Is he a liberal?"

that is sarcasm isn't it.

regardless of political leanings as a first act as SC Judge to not allow review of a death penalty case would be harsh.

but then again the way the dems were talking I thought he was going to personally execute every woman and black on the day he was confirmed.

I seriously doubt it...

He voted WITH everyone else and it was a 9-0 decision.

It's only temporary also.

This report makes it sound as if it were a 5-4 decision.

Another report says "The court's 9-0 action was procedural, however, because a stay was already set to expire Wednesday afternoon.

The court's 9-0 action was procedural, however, because a stay was already set to expire Wednesday afternoon.
