However, two Dakotan Democrats -- Sen. Tim Johnson of South Dakota and Sen. Kent Conrad of North Dakota -- have said they would vote down a filibuster. Johnson said he'll vote for Alito, and Conrad said he's "leaning in favor" of the candidate.

If Chaffee, Snowe, Conrad and Landrieu say they will vote for Alito, a cloture vote becomes meaningless, moot, a waste of time.

In trying to take away from President Bush the opportunity to introduce the latest Supreme Court Justice when GWB gives the SOTU address, the RATs will instead give him the perfect opportunity to speak out about rampant obstructionism.

If they do, then Bush and the GOP invoke the Nuclear option(s)...first the Senate Dems, then Iran. I really doubt they'd try that....yet. Frist (and a number of other Republican senators) really don't like the idea of changing the rules and will avoid it unless they feel there's no other choice left. I would be willing to bet that they'd let the debate go on for another day or so before pulling the trigger. It won't likely come to that anyway - I count over 60 votes to invoke cloture already (unless some Dems are lying).

I'm looking forward to watching the dems at the State of the Union when "I'm the President" Bush introduces or congratulates new Associate Justice Alito. The Repubs will stand and cheer and what will the dems do?
Hopefully, they will sit and glare for all of America to see.

Well, as I see it, Alito will be at the SOTU tomorrow night...either robed and sitting on the floor, or seated next to Mrs. Bush up in the balcony. The dems can choose their poison, but I think that they would be better off simply cutting their losses and letting Alito be confirmed without further delay.

In any case it sounds like the pro filibuster creeps will fall short, but it could be close. They are WAY short. A number of anti-Alito votes are also anti-filibuster. My count of anti-filibuster votes is up to 65.

Rumor floating around on the dark side - DEMOCRATS ARE TWO VOTES SHY OF A FILIBUSTER. It's hard to believe they'd actually do this at this point because of losing the impact the filibuster would have on the next SCOTUS nominee.
That said, the RATS are getting pretty darned desperate and who knows how many hot pokers their special interest masters are holding to their backsides.
