The VP doesn't vote today--he only breaks ties Having him in the chair to rule on a point of order (given enough debate - cloture has no play in the context of a judicial nomination) plays if there is a simple majority vote on appealing the chair's rule.

Chafee wouldn't do this unless the votes were counted and Alito had it made. He's just doing what he must to stay in office (like all the rest).

The good news is that AlGore is leading their poll of 2008 Presidential candidates with 45% of votes cast. Shrillary only has 7% and Kerry has 4%.

I'm getting the "all circuts are busy" again on phone numbers to the Capitol. The moveOners are burning up the lines to their senators, which leads me to believe that there will be 41 Dems today who will deny cloture.
Have I said lately how despicable they are!

The tantrum throwers have told Frist that if he invokes the constitutional option they will boycott the State of the Union address by the President. That sounds like a win/win for the President and the Republicans. It works for me.

I will go out on a limb and predict Snowe votes to confirm. Has she voted against many other GWB nominees? I am not sure but I doubt it. So Alito gets at least 57 votes (without Chafee,) or 58 if you include Conrad. I am still hopeful Landrieu, Bayh, and Menendez vote yes so Alito could get over 60. A narrow margin compared to the old days, but a landslide victory in the Demo-poisoned atmosphere of today.
