This morning, the Senate Judiciary Cmte. convenes for a final session in the nomination hearings of Judge Samuel Alito. Outside witnesses who did not testify at yes- terday's hearings are given an opportunity to offer their opinions on the nominee. The Cmte. meets again to vote, either to approve or reject, on Tues., Jan. 17

Nolan admits that there aren't enough facts re NSA/FISA bruhaha to justifay reaching a conclusion - maybe, if she knew the facts, she says, she'd find the surveillance to "be okay."

Tribe:"I'm not testifying for or against Judge Alito. I'm explaining why I am very troubled by his views. Obviously it follows from that ..that I'd be hard pressed to recommend his confirmation."..

You hit the nail on the head...
These dems are NOT even thinking about Alito right now...they are "testing the waters" for possible charges to be brought against the Bush Admin....and while they have the audience and the "right" lawyers in front of them, by gosh...they are gonna "try" George W. Bush!!!

Yeah - but what Tribe didn't expect was that his framing of testimony, the very words, "I'm not here to testify against the confirmation of Alito," would be the subject for discussion. Hoist on his own petard. Lesson is, if you are against, say so, and then defend your conclusion.
