Day 4: Hearing Resumes

This morning, Senators will question Judge Alito during a third round. They will then go into a closed session, to review the FBI background investigation on the Supreme Court nominee. Outside witnesses may be called to testify this afternoon, as well as the American Bar Association, to discuss its recommendations.

I know. I can't believe is 86. My grandfather is that same age, also lives in California and looks about 65 years old, too. Must be that sea air. :-D

He swore in Orrin Hatch who looks like he's going to cry.

I'm listening on XM radio but somehow I could just imagine that as Hatch's reaction. There is a lost decency revealing itself in some small ways with these last 2 witnesses.

Very forceful!

He says that Judge Alito is a great judge. We who have known him and heard his probing questions and have observed at first hand his impartial approach to decision making and his thoughtful judicial temperment, we who are his colleagues are convinced he will be a great Justice.

Great. Alito appears to be home free. Now we can pray that Congress will be cleaned up on our side and the earmarks will cease.

Hearing that chorus from the gallery-or the committe itself, I can't figure out which, since I'm not watching the proceedings-was kind of funny.

Leahy uttered a very sarcastic "Awwwww" upon hearing the story that Judge Aldisert swore Orrin Hatch in as a lawyer, and presided over his first case, which he won. He added, speaking to Orrin, "I didn't know you won one." Specter stepped in with the observation that Hatch and Leahy have always had this sort of relationship.

BTW, Hatch's tie is really cool.

That has baffled me for years. The answer to that question might very well be the key to decoding what it is that has sickened our national "leadership" over the last forty years.

It was from both. Hatch said "I'm glad you said that, they don't believe it", Leahy said, "Yeah, I never knew you won a case", Hatch said, you can see we get along so well. Laughs and grins from all.

Judge - the only way to mediate the conflicting impulses is to do what they should do anyway. Stay close to the record in each case that appears before them and make their judgements on that alone.

And knowing Sam Alito as I do, I am struck by how accurately these words describe the way he has performed on the Court and that is why, with utmost enthusiasm, I recommend he be confirmed as to SCOTUS.

3:43: Judge Aldisert is saying that Judge Alito's judicial record shows that Alito believes that legal outcomes will follow the law as dictated by the facts in any particular case.

Judge Aldisert campaigned with JFK in the presidential primary in West Virginia. The next year he ran for Judge and was on the Democratic ticket. Senator Joseph Clark was Aldisert's sponsor when he was nominated to the Court of Appeals. Robert Kennedy was a supporter. Judge Aldisert's point - political loyalties became irrelevant when he became a judge. The same can be said of Judge Alito. Judicial independence is incompatible with political loyalties and Aldisert believes that Judge Alito's record bares witness to this. Aldisert can represent to the committee that Judge Alito is among the first rank of the 44 judges with whom Aldisert has served.

Judge Aldisert begins his statement by discussing the ages of Judges. Judge Aldisert swore in Senator Hatch as a lawyer 40 years ago and presided over the first jury trial Senator Hatch had, and won.
