Schumer Gets Schooled on the Constitution

Sen. Chuck Schumer (D.-N.Y.) crafted the following questions for Samuel Alito in hopes, I suppose we're to assume, trap him on the question of a "right" to abortion.

Here's the transcript:

SCHUMER: Does the Constitution protect the right to free speech?

ALITO: Certainly it does. That's in the First Amendment.

SCHUMER: So why can't you answer the question of: Does the Constitution protect the right to an abortion the same way without talking about stare decisis, without talking about cases, et cetera?

ALITO: Because answering the question of whether the Constitution provides a right to free speech is simply responding to whether there is language in the First Amendment that says that the freedom of speech and freedom of the press can't be abridged. Asking about the issue of abortion has to do with the interpretation of certain provisions of the Constitution.

SCHUMER: Well, OK. I know you're not going to answer the question...

You can't answer ANY Constitutional question without going to precedent. Anyone who has taken high school civics knows this.

That has been claimed, but I would argue that position to be illegitimate. Any decision which cannot be justified without the use of stare decisis is illegitimate.

To be sure, there are sometimes cases where reasonable people might reach different results. And there is nothing wrong with using stare decisis to select among multiple opinions which would be equally valid in its absense. But no matter how many court decisions find the Lautenberg Abomination or McCain Feingold to be constitutional, they never will be unless or until the Constitution is amended.

Don't forget, as a former attorney and prosecutor himself, he could BS with the worst of them and could, in all probability, out-BS most, if not all - or he wouldn't be where he is. It would be out of place in the hearings, but would be a lot of fun to watch him BS'tting Schumer into the corner and then out of the window.

One truly scary thing is to KNOW that there are MILLIONS of people who VOTE for people like Chucky, Chappy, Hillary & Durbie. When I 'think' about that it is truly frieghtening!!

Of the people that vote for DemocRAT anything...local, state or federal, my theory is this: 80% of DemocRAT voters are so incredibly stupid & willingly ignorant & naive of who or what they are voting for. This is irregardless of their educational background or level. I work for a boss who is a highly moral, religious practicing Catholic.....yet votes for DemocRAT every time. He makes absolutely no correlation to the DemocRATs anti-American, anti-Catholic, anti-Christian, pro-homosexual, pro-abortion policies. The other 20% of DemonRATS are nothing more than self-loathing Americans who for some strange psychotic perverted set of reasons absolutely hate America, Judaism, Christianity & moral/family/pro-life values and do everything in their power to destroy these priniciples & ideals. I think this 20% includes nearly all the RAT B@ST@RD DimWit senators and representatives.

You're right, its scary when you consider that our country can literally be voted into oblivion by these millions of ignorant, stupid, naive idiots.

Others include affirmative action quotas, allowing voter fraud, and obstructing the ability of the opposition party's President during a time of war.

Schumer is supposed to be the best that the Dims' have - their sharpest blade - and Alito made Schumer look like a complete fool. The only question that remains is whether Roberts or Alito is smarter than the other - in any case, it's two home runs for Bush. These two, with Scalia and Thomas, and the wavering Anthony Kennedy, may re-make the Supreme Court.

"Abortion is the one issue that holds their party together. I've asked innumerable Democrats who hold moderate to conservative positions on most issues to tell me why they vote Donkey, and 95% of them cite "abortion" as the reason. .....the other 5% usually mumble something about "the environment." Without the "pro-choice" movement the Democrat Party as we know it would cease to exist."

I know one guy from work who votes democrat because he thinks "republicans are for rich people". I don't believe he holds a strong opinion on abortion.

Abortion industry donates huge sums of money to the RATS.

If Roe is struck down on a federal level it will then be up to the states to decide the issue.

That means that instead of buying 50 senators, NOW, NARAL, and assorted abortion lovers will have to spend millions upon millions of dollars in 50 states to buy legislative votes.

On the other side of the issue, if Roe is struck down the RATS in D.C. will be getting no more funds from the baby killer groups.

It's all about money. Many of these dems were pro life before NOW and NARAL came into being.

Imagine being so greedy for power that you would turn your back on the life of a baby in the womb. Turn your back on your religion.

These are the people who have the vapors over the thought of inconveniencing the caribou in ANWR.
