Another thing. In order for a decision to have any Stare Decisis (precedence) value, the opinion MUST be published.

As an appeals court judge, his decisions would only have effect in his district. In other words, a decision made in California only has effect in the 9th Circuit (the western states).

The same issue may have another outcome in Iowa. When there are disparate results for the same issue, then the Supremes come into play. They resolve the issue. Of course, in the 9th Circuit situation, the rulings there are more often than not ruled as unconstitutional before that happens.
