well, on this civilian transfer case - Napolitano was nuts to say they would lose that one - was he predicting Padilla would be released?
But I (unfortunately) agree that if (when) the combatant case goes to the SCOTUS, Padilla will win that one.

I have. I was under the impression that most of the comments were discussing the underlying cause of action, wehre the prevailing speculation is that the government will lose that case.
But I guess you follow FR commentary more closely than I do. At any rate, I'm glad I flagged you so you could clarify that you weren't referring to the underlying cause of action with your "Hotshot lawyers all over the place have been telling us this is illegal."
Ahem. Since I've been directly posted to regarding Judge Napalatano's comments regarding both this case today and the underlying case, I would say it's safe to assume I've been following "FR commentary more closely" than you do.
do you know anything about the actual charges they are bringing in the civilian case? is that a strong case?
No, we can't hang him yet. He has to have a trial first...THEN HANG HIM.
This template gives the administration some interesting tools to keep suspected terrorists off the streets. Start with military trial, delay as long as possible, switch to criminal charges, delay as long as possible. Repeat as necessary.

I don't think the administration will do that at all. the lesson learned from this Padilla case is:
- capture people overseas and hold them in foreign prisons so the federal courts can't get to them
- follow the model of the US citizen taken out in Yemen by the CIA with a drone missile. there isn't anything left of him for an appeal or a trial

That would work. But I would be fine if there were hundreds of little bunny pictures embroidered on it.
And a cowardly SCOTUS punts the case once more, rather than having the guts to stand up and make a decision one way or another. I can't believe Scalia didn't run around the room kicking and screaming to take this case after his previous comments. This could have been a great case to settle this dispute. Instead, it's become a sad showing of SCOTUS timidness.

Jose Padilla, a U.S. citizen held in a Navy brig as an enemy combatant for more than three years, was charged Tuesday with being part of a North American terror cell that sent money and recruits overseas to "murder, maim and kidnap."However, absent from the indictment were the sensational allegations made earlier by top Justice Department officials: that Padilla sought to blow up U.S. hotels and apartment buildings and planned an attack on America with a radiological "dirty bomb."
